Support for filling out the electronic declaration of a civil servant to the NAZK

Submission of electronic declarations is a mandatory component of the activities of civil servants. After filling out, they are published on the website of the NAPK and are publicly available. Some changes were made on February 24, 2022. In order to protect the personal data of Ukrainian politicians and civil servants, access to the public part of the Register of Declarations was closed by the NPC.

What information should be included in the declaration?

In the electronic declaration, it is necessary to indicate reliable information about the property and income of the civil servant:

• Property (movable and immovable).
• Transport, other types of movable property.
• Jewels, securities, cash.
• Objects that are under construction.
• Intellectual Property.
• Total incomes both by the main place of work and by part-time work.

Important:  the declaration includes not only data on the income of the declarant, but also information on the property of his family members.

What is the responsibility for incorrect or untimely filling of the electronic declaration?

Failure to submit an electronic declaration on time is subject to liability in accordance with Article 172-6 of the Code of Administrative Offenses ("Violation of Financial Control Requirements"). The penalty is a fine from 50 to 100 NMDH (tax-free minimum income of citizens). If knowingly incorrect information and data are specified in the electronic declaration, the fine is from 1,000 to 2,500 NMDH.

In the case of bringing a public servant to administrative responsibility, he loses the right to occupy the corresponding position and is subject to dismissal.

Law No. 2115-IX entered into force on March 7, 2022. According to this Law, submission of any reporting is carried out within 3 months after the expiration of martial law. It is about:

• Annual declarations and declarations after dismissal for 2021.
• Declarations of candidates for the year 2021, if the person was appointed to the position during martial law.
• Declarations upon release during martial law in Ukraine.

If a civil servant takes part in hostilities and does not have the opportunity to submit an electronic declaration within three months after the end of martial law, he can do so within 30 days from the end of the consequences that were an obstacle to submitting the declaration.

Conscripted officers, mobilized workers, and contract workers are exempted from submitting declarations. If the specified categories are related to local self-government officials, they must declare their property and income.

Thus, if possible, it is better to submit a declaration to the NACP in a timely manner.
