Stay of foreigners on the territory of Ukraine during the war

The introduction of martial law in Ukraine slightly changed the rules for crossing the border and the stay of foreigners on the territory of our state.

To cross the border, a foreigner must have:

  • valid foreign passport;
  • visa (if there is no visa-free agreement between the foreigner's country of citizenship and Ukraine);
  • a valid medical insurance policy (it must be either a Ukrainian insurance company, or a foreign one, but which has a representative office on the territory of Ukraine);
  • confirmation of financial capabilities for the entire period of stay in Ukraine and for returning to the foreigner's country of citizenship);
  • confirmation of the purpose of the trip (for example, private, that is, an invitation from an individual, or a tourist invitation; participation in events, etc.).

WARNING! A visa entry regime has been introduced for citizens of the Russian Federation since the beginning of martial law. That is, if you do not have a permanent or temporary residence permit on the territory of Ukraine, contact the nearest Ukrainian embassy and issue a visa.

 

Also, during the war, the entry rules for foreigners - military personnel were changed. In accordance with the legislation of Ukraine, foreigners and foreign nationals who have signed a contract with the Armed Forces do not need to open a visa for entry, as well as prepare additional documents at the migration service. The term of their stay is considered legal as long as the contract is valid, that is, they can stay in Ukraine longer than the allowed 90 days for 180 days, without issuing a residence permit.

It is also important to note that when crossing the border, the border service has the right to refuse to cross the state border (if the necessary conditions for crossing are not met) or to prohibit entry into the territory of Ukraine. At the same time, if we talk about the refusal to cross the border, then such a decision is one-time, that is, after eliminating the shortcomings, the foreigner has the right to try to enter Ukraine again. But the decision to ban entry is much more serious, because it is usually issued for a long period of time, and due to the commission of a certain type of offense on the territory of Ukraine. Such a decision can be appealed if there are grounds for it.

All foreigners and foreign nationals who entered Ukraine legally, are here without violating the period of stay, and also have the appropriate reasons, have the right to issue a temporary residence permit (for example, based on employment, marriage to a Ukrainian, volunteering, study in a Ukrainian university, etc.) or a permanent residence permit (on the basis of investments in the economy of Ukraine, birth on the territory of our state, the presence of a child of a citizen of Ukraine, family reunification with a foreigner who already has a permanent permit in Ukraine, etc.).

To do this, it is necessary to collect the necessary package of documents, such as:

  1. a valid foreign passport;
  2. a translation of a foreign passport;
  3. a type D visa (for visa countries);
  4. a medical insurance policy;
  5. a document that is the basis for obtaining a permit;
  6. and other documents; and apply to the migration service at the foreigner's location to obtain a residence permit in Ukraine.

 

Important moment! You must have at least 15 working days before the end of your legal stay in Ukraine or the expiration of your visa.

If there are reasons, while waiting for a residence permit, or an immigration permit (this is a document obtained in the process of issuing a permanent residence permit), a foreigner has the right to submit an application to the migration service for an extension of his legal stay in Ukraine. Such an application can be submitted no earlier than 10, and no later than 3 working days before the end of the period of stay in Ukraine.
