Stay of foreigners in Ukraine for more than 90 days

For all foreigners and stateless persons staying in Ukraine, the rule is that you cannot stay more than 90 days in 180 calendar days. If you are a citizen of a country that does not have a visa-free entry agreement with Ukraine, you will need to apply for a visa. This can be done at the Ukrainian embassy in the country where you are physically located.

However, every foreigner, if there are legal grounds for it, can obtain both a temporary and a permanent residence permit. This gives you the right to reside in Ukraine for a longer period than the standard time limit.

 

If there are no such grounds, and you are forced to stay in Ukraine longer than allowed for certain reasons, then you can extend your legal stay. Such reasons may include, for example, pregnancy and childbirth, illness, inheritance, etc.

Temporary residence permit

A temporary residence permit is a document that allows you to reside in Ukraine for at least one year.

The grounds for obtaining such a residence permit are: marriage with a Ukrainian citizen, studying at a Ukrainian university, employment with a Ukrainian employer, work in a charitable foundation, volunteer organization, etc.

A foreigner must submit the package of documents in person to the migration service. The processing time for such a document takes 15 business days.

Be careful. Even if you have a visa-free regime for entering Ukraine, you will need to travel abroad to obtain a type D visa to obtain a residence permit.

There are only 6 countries for which a visa is not required in this case, and these are citizens of:

  1. Azerbaijan
  2. Belarus
  3. Armenia
  4. Georgia
  5. Moldova
  6. Uzbekistan.

For citizens of the Russian Federation, since the beginning of the full-scale invasion, a visa is required for both obtaining a residence permit and even for entry.

Documents must be submitted 15 working days before the end of the legal period of stay, or before the expiration of the visa.

Permanent residence permit

A permanent residence permit is a document that allows a foreigner to reside in Ukraine indefinitely. It is issued in the form of an ID card, with the condition of exchange every 10 years.

The grounds for obtaining such a document are an immigration permit, which is obtained from the state migration service.

 

Such an immigration permit can be obtained if: the foreigner has been married to a Ukrainian citizen for more than 2 years; the foreigner is a former citizen of Ukraine who has officially renounced our citizenship; the foreigner has a child with Ukrainian citizenship; and the foreigner has made an investment of USD 100 thousand or more.

A visa is not required to apply for an immigration permit. A foreigner can apply without it. The condition is a legal stay on the territory of Ukraine. In the future, if the decision is positive and you are granted an immigration permit, you will need to leave for a D-01 visa for immigration.
