State registration of common ownership rights to a land plot

We announce that by the decree of the Cabinet of Ministers of Ukraine No. 925 "Some questions on the improvement of mechanisms for the protection of rights to land plots", amendments were made to the Procedure for state registration of rights to immovable property and their encumbrances, approved by the Cabinet of Ministers of Ukraine from December 25, 2015, No. 1127.

In particular, paragraph 20 of the Order specifies the peculiarities of the state registration of the right of common ownership of a land plot, which entered into force on December 9, 2018.

In the course of state registration of the right of common ownership of a land plot in one of the co-owners, in the presence of information in the State Land Cadastre received in accordance with this Procedure, information on the right of common ownership of the land plot, indicating all co-owners transferred from the state register of land, the state registrar simultaneously with the state registration of the right of joint ownership in one of the co-owners also transfers information about other co-owners to such a land plot to the corresponding open section in the State Register of Rights to Real Estate.

The transfer of information about each of the co-owners to the land plot is carried out in the absence of rights in the State Register of information on the transfer of ownership of the co-owner of the right to a third person. If, in accordance with the present Procedure, information received from the State Land Cadastre, in addition to the information on the right of ownership of a land plot, information transferred from the state register of land on other property rights, the state registrar simultaneously with the discovery of a section in the State Register of Rights also transfers such information from the State Land a cadastre about the rights of rights to such a land plot, and the subjects of these rights in the corresponding open section.
