RULES FOR RETURN TO UKRAINE IF THE CHILD WAS BORN ABROAD

Reading time: 4 min.

Unfortunately, a large number of Ukrainian citizens were forced to leave the territory of Ukraine since the beginning of the full-scale invasion of the Russian Federation. One of such people are Ukrainian women who decided to give birth to a baby abroad in order to protect themselves and the newborn from danger.

First of all, after birth, the issue of correct registration of the child in another country arises. Registration of a newborn person for citizens of our country who permanently or temporarily reside in another country is carried out by diplomatic or consular institutions of Ukraine in the country of your stay. One of the applicant parents must prepare a written application for registration of the child's birth and submit it for official registration at the place of birth of the child or at the place of residence of one of the parents. Moreover, in case of force majeure situations (such as, for example, sudden illness, death of parents), the right to register a newborn can be transferred to the child's relatives or transferred to other persons by proxy.

For more up-to-date information, we advise you to contact a lawyer or immigration lawyer.

Before submitting the documents to the relevant institution, parents should collect the necessary package of documents. These include:

  • Document from the maternity hospital about the birth of the child;
  • Passport documents of parents or one of the parents;
  • A written or oral application to include information about the father in the child's birth certificate.

Let's move on to the issue of birth registration by the institution.

Both citizens of Ukraine and foreigners should remember that the birth of a child can be registered only at the consulate of Ukraine. It is in this institution that the child's name, surname, and patronymic are later assigned.

The terms are important in this case, because there is a risk of leaving the child without documents. The application for registration must be submitted by parents or authorized persons no later than one month from the day of the child's birth.

If a tragic situation occurred and the child was stillborn, then 3 days are given to submit an application.

Subsequently, the parents of a newborn child have the following question: how to return to Ukraine, so that the child is not allowed at the border?

Remember that no person who is a citizen of Ukraine can be restricted in the right to cross the border of his Motherland under any circumstances in accordance with the Law of Ukraine "On the procedure for exiting and entering Ukraine by citizens of Ukraine".

First of all, you need to understand what documents you need to have with you:

  • The most important document is a valid passport of a citizen of Ukraine of the parents;
  • The next important document to present at the border for a child is a birth certificate issued by a consular institution of Ukraine.

Please note that the birth certificate issued in another country has been legalized for Ukraine. This procedure is drawn up so that the document issued abroad has permanent legal force on the territory of Ukraine in accordance with laws and international treaties.

In case the parents forgot or it was impossible to legalize the document, upon arrival in Ukraine, it is necessary to apply to the body and department of state registration of civil status acts with a request for registration of the newborn child.

But, it is better to pay attention to this point in advance to avoid disputes and problems in the future.

A person born abroad retains his status as a citizen of Ukraine while outside Ukraine. The relevant data on a person's citizenship and nationality are not entered into the act record of birth and birth certificate, but simply a mark is placed in the column "For records".

Therefore, the place of birth of the baby does not affect the probability and the right to acquire the citizenship of Ukraine.

So, in conclusion, I would like to add that when carrying out any manipulations with documents abroad, always seek professional help from a lawyer in the relevant field, so as not to make mistakes. However, if you have questions that need to be resolved with the collection of documents or, for example, with filling out an application abroad, you can always contact our specialists in migration practice.
