RETURN OF MILITARY PENSION ON THE BASIS OF INFORMATION ON THE AMOUNT OF CASH SECURITY

Volodymyr Yuriyovych turned to JSB “Prikhodko&Partners” for help in recalculating his military pension. The pensioner was dismissed from military service from the post of chief of the rear of the command of the land forces of the Armed Forces.

Until 2018, the Plaintiff was accrued a military pension based on the following components of cash security for the calculation of pensions:

• salary;
• salary for military rank;
• seniority allowances;
• additional types of cash security.

The Main Department of the Pension Fund of Ukraine in Kyiv region in 2018 recalculated the client's pension on the basis of the Certificate on the amount of cash security for recalculation of pensions as of 01.03.2018, according to the Cabinet of Ministers of 21.02.2018 № 103 "On recalculation of pensions military service, and some other categories of persons" and did not take into account additional types of cash security when calculating pensions.

At the request of the pensioner, the Kyiv Regional CCC and JV prepared a certificate on the amount of cash security as of March 5, 2019 dated July 7, 2021 № 2/3/1/2853 in a similar position (on the day of dismissal) held by Volodymyr Yuriyovych indicating monthly additional types of cash software.

However, the Main Department of the Pension Fund of Ukraine in Kyiv Oblast refused to recalculate the pension on the basis of a certificate issued by the Kyiv Oblast CCC and JV on the amount of cash benefits, taking into account additional types of cash benefits.

In pursuance of the decision of the District Administrative Court of Kyiv of 16.11.2021 in the case № 640/23663/21 T V.Yu. the pension was recalculated on the basis of the certificate on the amount of cash security dated July 7, 2021 № 2/3/1/2853 as of March 5, 2019, including the following components of cash security:

• official salary - UAH 9,160.00;
• salary for military rank - UAH 1,480.00;
• allowance for years of service (50%) - UAH 5,320.00;
• allowance for the peculiarities of service (65%) - UAH 10,374.00;
• service allowance under regime restrictions (20%) - UAH 1,832.00;
• premium (35%) - UAH 3,206.00,

which were taken into account before the recalculation of the pension, starting from April 1, 2019, taking into account previous payments and transfer and pay a pension of 74% of cash benefits, starting from January 1, 2018, taking into account previous payments.

The amount of surcharge in terms of recalculation for the period from 01/01/2018 to 31/01/2022 is UAH 165,271.92.

From 01.02.2022 the pension will be paid in the amount of UAH 19,340.
