Restoring the notary’s access to state registers after disconnection

The full-scale invasion of the troops of the Russian Federation on the territory of Ukraine made adjustments in all spheres of our life. The legal sphere was no exception. With the beginning of martial law, access to the State Register of Rights to Immovable Property (we are talking about the Real Estate Register) was closed. This caused a number of negative consequences. In order to achieve the stability of economic development, state registrars are gradually gaining access to the Real Estate Register. The access of notaries to state registers in the conditions of martial law is regulated by Resolution of the Cabinet of Ministers of Ukraine No. 480 dated 19.04.2022 "On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine Regarding the Activities of Notaries and the Functioning of Unified and State Registers, the Holder of which is the Ministry of Justice, in Conditions martial law".

How to restore access to state notary registers?

According to the above-mentioned Resolution, only those notaries who have been included in the List of notaries approved by the Ministry of Justice have access to state registers.

We are talking, first of all, about state registrars and notaries. Access to state registers is not granted to civil servants in those cities and settlements where there is a threat of unauthorized access to them: areas of hostilities, territories under temporary occupation. At the same time, the resolution provides for certain conditions of access to the Unified State Register for state and non-state notaries.

Notaries who carry out their professional activities in administrative-territorial units that are not included in this list have access to:

• Inheritance register.
• Unified register of special forms of notarial documents.
• Electronic register of apostilles.
• Unified register of powers of attorney.
• State register of movable property encumbrances.
• State register of acts of civil status of citizens.
