Criteria for recognizing an enterprise as critical

A company is recognized as critical if it meets certain indicators. Among the key ones, the following should be highlighted:

Financial contribution to the economy

• payment of taxes and social security contributions above the established threshold (equivalent to 1.5 million euros per year);
• significant foreign exchange earnings (equivalent to over 32 million euros).

Strategic or industry status

• inclusion in the list of strategic state-owned objects;
• definition as being of importance for the industry or territorial community (by decision of the relevant government body).

Tax discipline

• absence of debt to the budget and social security contributions.

Payment level

• compliance with the established minimum average wage.

Special status or type of activity

• residency in Diya.City;
• activities in the field of defense production, energy, critical infrastructure, communications;
• international transportation, healthcare, education, social sphere, media, etc.

Important! The general rule for obtaining criticality is compliance with three or more criteria. For certain categories (energy, medicine, education, carriers, public sector, etc.), two are sufficient, while the requirements for the absence of tax arrears and salary level remain mandatory.

Who cannot be booked?

There are certain categories of citizens who are not subject to booking, including:

1. removed / excluded from registration;
2. not officially employed;
3. who have a deferment on another basis;
4. persons about whom there is no information in the Oberig register;
5. who are wanted by the CCC;
6. have not updated their military registration data;
7. do not have a military ID card.

According to the last four subparagraphs, temporary booking is possible for no more than 45 days from the date of employment. During this period, the conscript must eliminate deficiencies in military records, but if this is not done, the employer has the right to dismiss the employee.

Not every organization has a chance to objectively apply for this status, and therefore a preliminary legal audit will help you avoid an unjustified refusal.
2. Prepare a complete package of documents. They must be current at the time of submission and certify compliance with the requirements. If the company is applying on an industry basis, it is necessary to prove its importance for the relevant industry.
3. Monitor financial indicators. Particular attention should be paid to the absence of tax arrears and compliance with the established minimum wage level.
4. Do not delay with legal assistance. In practice, there are often situations when an organization first tries to apply on its own, receives a refusal, and only then turns to a lawyer for criticism - as a result, time is lost and re-submission becomes more difficult.
