RESIDENCE PERMIT FOR CITIZENS OF THE REPUBLIC OF BELARUS

If you came to Ukraine and decided to stay here longer than the law allows - i.e. more than 90 days, then you need to get the so-called legalization.

In order to obtain a residence permit, citizens of the Republic of Belarus must first of all understand the distinction between temporary and permanent residence. Temporary, in turn, is granted for a period of up to one year and subsequently requires either an extension of the period of stay or departure from the borders of Ukraine.

As a matter of fact, the procedure for obtaining and submitting documents is almost nothing and in no way different from the standard procedure for obtaining documents by citizens of other countries.

Also, an important aspect is distinguishing the reasons for which you have to or want to stay in Ukraine - be it study, be it treatment, be it marriage, family.

*It is important to remember that if you are in Ukraine on the basis of a military contract (Army during martial law), this procedure for obtaining a residence permit is managed by the Ministry of Defense of Ukraine.

In all other cases, documents for registration of temporary or permanent residence are submitted to - territorial divisions/ or territorial bodies of the State Migration Service of Ukraine.

The submission of documents for the order for receiving the service is carried out either by the applicant personally, or through a legal representative on the territory of Ukraine - with the help of our specialists.

If your goal is to obtain permanent residence in Ukraine, carefully monitor whether you have a valid temporary residence permit in Ukraine (the grounds may be marriage to Ukrainian citizens, employment, work, study, volunteering, journalism, family reunification) .

Documents for a residence permit in Ukraine are submitted no later than 3 days before the end of the permitted period of stay.

If all the above requirements are met and you are going to submit documents for permanent residence, then the appropriate documents are provided. The list of documents, in fact, also depends very much on the basis on which you will refer when applying for permanent residence. Most often, there are cases of submitting documents on the basis of birth certificates, marriage certificates, certificates of no criminal record, health status, and unpaid fines.

List of documents (standard), which must be submitted together in one folder:

• Passport/identity document;
• A document confirming your actual place of residence and family composition;
• Residence in Ukraine;
• Marriage certificate (if available);
• Certificate of criminal record;
• A document on the state of health (namely, the absence of alcohol / drug addiction;
• Three photo cards.

The term of consideration of documents always does not exceed 15 working days. During this period, all documents and information will be reviewed and carefully checked in the database by employees of the migration service. If there are no violations or discrepancies, an immigration permit will be issued. However, the result may not always be positive, that is, there may be a refusal to issue (issuance of) a permit for temporary residence in Ukraine.

• The refusal may be for the following reasons:
• Incorrect filing of the application;
• Inconsistency of documents;
• Lack of translation of identity documents into Ukrainian;
• At the time of receiving the decision, you were illegally in the territory of Ukraine.

In this case, an appeal is filed with the State Migration Service, its territorial bodies or the district administrative court. The complaint is submitted personally by the appellant or through his legal representative.
