REGISTRATION OF THE BIRTH OF A CHILD WITH THE SIMULTANEOUS DETERMINATION OF ITS ORIGIN (OBTAINING A BIRTH CERTIFICATE)

When a child is born, a legally important and responsible moment is to determine the origin of the child from the father and mother, which is carried out simultaneously with the registration of the child's birth.

Parents have one month to register the birth of their child with the state registration of acts of civil status (ZAGS). If this is not done within a month, liability arises in accordance with the law (fine). In addition to registry offices, you can register a child in the executive committees of village and city councils, in the centers for the provision of administrative services at the place of residence. You can apply for registration in person or through an authorized legal representative.

What documents do I need to submit? (incomplete list)

  • Application for state registration of the birth of a child
  • A document issued by a health care institution that confirms the fact of the birth of a child
  • Documents drawn up in a foreign language together with translations (if the parents are foreigners)
  • Marriage certificate
  • Parents' passports (or one of them)
  • Court decision on establishing the fact of the birth of a child in the temporarily occupied territory

During registration, the child will be given a first name, last name and patronymic, and as a result of receiving the service, the child will receive a birth certificate. A birth certificate is thus a certificate of state registration of a civil status act. From the moment of registration of this act, undoubtedly the most important in a person's life, a person becomes a subject of civil rights and obligations, that is, he can enjoy the rights of a citizen of Ukraine and is obliged to bear obligations under the law. This is indicated in article 2 of the Law of Ukraine "On state registration of acts of civil formation".

There are cases when a child is born on the territory of another state, but is not officially registered there by the relevant authorities or diplomatic missions or consular offices of Ukraine. In this case, the basis for registering such a child in Ukraine will be a medical document of another state, which confirms the fact of the birth of a child, is properly legalized for use on the territory of the state of Ukraine.

 

If the state authorities refused to provide you with the service, you can appeal this decision both in court through the administrative court (you have 6 months from the date of receipt of the refusal), and out of court by filing a complaint with the Ministry of Justice of Ukraine. The latter option is more effective, since the term for considering a complaint is 1 month, while in court it is 2 months, but at the same time, there is 1 month for filing a complaint from the date of receipt of the refusal.
