Registration of the birth of a child abroad. What do you need to know?

After the beginning of the full-scale Russian invasion, a significant part of Ukrainians had to look abroad for opportunities for a safer life. And this life continues, children are born in it. And therefore - it is necessary to solve related documentary issues. When a little Ukrainian man or woman is born, this fact requires proper legal certification. Let's tell how it happens.

Where to register the birth of a child?

The start of a full-scale war did not change either the list and powers of such institutions, or the legal framework that regulates this issue. Therefore, registration of the birth of a child abroad takes place in diplomatic missions and consular institutions located in other countries.

The regulatory document that regulates this area is the Instruction on the Procedure for Registration of Civil Status Acts in Diplomatic Missions and Consular Institutions of Ukraine. This guideline was approved on May 23, 2001, and was last revised in September 2004.

Therefore, the registration of the birth of a child is carried out by the consul. At the same time, at this moment, she is assigned a surname, first name, and patronymic, and paternity is determined. This should be done at the place of birth of the child or the place of residence of his parents. If there are reasons that make this impossible (for example, illness or death of parents), the application can be submitted by the child's relatives. It can also be done by a representative of the health care facility where the child was born.

Sometimes there are situations when the birth of a child took place on a ship or in an airplane during a trip. In this case, it will be possible to register the baby's birth at the nearest consular institution.

The application for registration of the birth of a child must be submitted no later than within a month from the moment of its birth. If the child is stillborn, then there are three days.

What documents are submitted?

The following list of documents must be submitted:

• a document from a medical institution certifying the birth of a child;
• passport documents of parents;
• a document that provides information about the father, if he himself is not present with his passport (marriage certificate, statement of the mother or father on recognition of paternity, statement of the mother and her husband on non-recognition of his father).

It can also be a joint statement of a man who is married to the child's mother and the real biological father of the child. This happens in cases where the child's father and her mother's husband are different people. In a word, the legislators have carefully foreseen the entire mechanism in the most diverse situations.

If all documents are submitted in accordance with the procedure established by law, the birth certificate of the child is usually issued on the day of such application.
