REGISTRATION OF MARRIAGE WITH A FOREIGNER UNDER THE CONDITIONS OF MARITAL STATE

Despite the war, life goes on. At the same time, marriages, births and other acts of civil status are registered. If with the beginning of the war, for citizens of Ukraine who want to get married, the procedure for marriage registration was simplified and even online registration was allowed, then a natural question arose, what about foreigners? Foreign citizens have the right to register a marriage in wartime according to general rules.

Where should I contact?

With an application for marriage registration, you can apply to any department of the State Registration of Civil Status Acts, regardless of your place of residence or stay. The application can also be submitted through the online services of the Ministry of Justice.

Necessary documents

It is necessary to provide documents confirming the identity of the applicant. For a citizen of Ukraine, this will be a passport, and for a foreigner, a certificate of permanent or temporary residence in Ukraine. Also, if the persons had a previous marriage, then it is also necessary to provide documents confirming its dissolution (depending on the situation, this may be a certificate of dissolution of marriage, the death of one of the spouses, or a court decision to dissolve the marriage or declare it invalid).

If the marriage was dissolved in another state, such a document on the dissolution of marriage must be translated into Ukrainian and notarized.

Features

There are certain peculiarities when registering a marriage with a citizen of another state. In particular, this refers to the fact that, after receiving an application for marriage registration, the DRATS body is obliged to check the data on the foreigner and his legality of stay in Ukraine. For this, a request is sent to the State Migration Service on the day of submitting an application for marriage registration.

Term

After receiving an application for marriage registration, such registration is possible after one month from the date of submission of the application. If there are valid circumstances (for example, a woman's pregnancy or other valid reasons), the marriage can be concluded earlier.

Peculiarities in the conditions of martial law

If one of the future spouses is serving in the Armed Forces of Ukraine or other formations that are involved in the defense of the country, the marriage is concluded according to a simplified procedure, within the time limit requested by the applicants. Also, if one of the applicants is on duty and cannot personally attend the marriage registration, such registration can be done online.

Cost

Filing an application for marriage registration is free of charge, and a state fee is charged for marriage registration.

So, despite the state of war in our country, the registration of marriage with a foreigner takes place in the usual way. Of course, certain difficulties or peculiarities may arise in each situation (impossibility to obtain documents on the previous dissolution of marriage, lack of passport documents, etc.), but this is no reason to postpone the joyful event until later.
