REFERRAL OF SERVICEMEN FOR TREATMENT ABROAD

The Cabinet of Ministers of Ukraine of October 14, 2022, in its resolution № 1169, noted changes in the Procedure for sending persons from the defense forces and security forces injured in connection with the military aggression of the Russian Federation abroad.

Persons who are currently in military service and who took part in measures necessary for the security of Ukraine's defense and were directly in the areas of implementation of the said measures, have the right to receive treatment abroad at the expense of the state budget. To receive such treatment, a serviceman will need to go through several stages.

• First, you need to get a referral for treatment in a foreign institution. In order to receive this document about treatment abroad, it is necessary to submit an application to the administration of the health care institution in which the serviceman is serving, as well as prepare a request for the need for such treatment. As a next step, this request is sent by the relevant health care institutions with a package of documents about the health of the applicant (about his data and consent to the processing of information) to the health care units of regional, city state administrations and other central executive authorities.
• Secondly, the decision on referral for treatment abroad is made by the Commission of the Ministry of Health. Also, the decision takes into account the costs of sending a citizen of Ukraine abroad (including the costs of paying the cost of treatment, reimbursement of the cost of travel and return).
• Thirdly, referrals for treatment abroad are made based on the conclusion of the military medical institution. That is, it is necessary to obtain this conclusion, for this it is also necessary to apply to the institution in an arbitrary form with the addition of documents on consent to treatment, consent to the processing of personal data by health care institutions, extracts from the patient's medical card. After receiving the petition, a commission is formed, which considers the possibility of making a decision on referral for treatment abroad of Ukraine.

Also, it is important to obtain consent (written confirmation) from the foreign health care institution to which the conscript wishes to come for treatment. The agreement must state that the health care institution is ready to accept the person on the basis of free treatment.

That is, if a serviceman who needs treatment has all the necessary certificates, documents, answers and resolutions of health care institutions, in accordance with the Resolution of the Cabinet of Ministers of Ukraine on the approval of "Rules for crossing the state border by citizens of Ukraine" № 57-95-p, he has the right to travel abroad to receive medical assistance.

The transportation of the person will be carried out by the Ministry of Health, and in the future also by the Ministry of Foreign Affairs. Also, the departure of military personnel for treatment is possible accompanied by one of the family members of the first degree of kinship (parents, husband or wife, children of the person, including adopted ones).
