RECEIVING DELAY DURING MOBILIZATION FOR STUDENTS

Pursuant to paragraph 2 of part 3 of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization", applicants for professional (vocational and technical), professional pre-higher and higher education, assistant trainees, graduate students and doctoral students who are studying are not subject to military service during mobilization by full-time or dual forms of education.

That is, students of vocational, technical, vocational, pre-university and higher education institutions who study full-time or dual-time education have the right to receive, on this basis, a deferment from conscription for military service during mobilization.

We also draw your attention to the fact that, for example, part-time education does not create grounds for receiving a deferment from conscription for military service during mobilization, but only full-time and dual education. In accordance with Article 9 of the Law of Ukraine "On Education", a method of obtaining education is recognized as a dual form of education, which involves the combination of training of individuals in educational institutions (at other subjects of educational activity) with training at workplaces at enterprises, institutions and organizations for the acquisition of a certain qualification, as a rule, on the basis of a contract.

It is worth noting that this article applies not only to persons who for the first time acquire one or another education that gives the right to receive a deferment from conscription for military service during mobilization, but also to those for whom it may be the second or third, for example. That is, the current legislation of Ukraine does not set limits on the number of educations for conscripts and does not provide for age criteria for obtaining such an education.

The only determining factor is studying in a vocational, technical, professional, pre-university or higher educational institution under full-time or dual forms of education.

In the event that you are a student of a vocational, professional, pre-university or higher education institution and are studying full-time or dual education, it is necessary to submit relevant supporting documents to the territorial recruitment and social support center. Such documents can be: a certificate from a month of study, a study contract, etc.

 

Notifying the territorial recruitment and social support center about the fact of your training is necessary not only to fulfill the obligation stipulated by the legislation of Ukraine about changes in both marital status and the existence of grounds for receiving a deferment from conscription for military service during mobilization, but also for to avoid mobilization. After all, the fourth part of Article 26 of the Law of Ukraine "On Military Obligation and Military Service" does not provide such grounds for dismissal from military service. Unfortunately, there are rare cases when a conscript has reasons to receive a deferment from conscription for military service during mobilization, but he is still mobilized, in particular, because he himself did not report such circumstances.
