RECALCULATION OF MILITARY PENSION DURING MARTIAL LAW

Ivan Volodymyrovych turned to JSB "Prikhodko and Partners" for help in recalculating his military pension. The pensioner was discharged from military service from the position of senior officer of the operational management department of the military district headquarters.

Until 2018, the Plaintiff was accrued a pension based on the following components of cash security for the calculation of pension:

• salary;
• salary for military rank;
• allowances for years of service;
• additional types of cash security.

The Main Department of the Pension Fund of Ukraine in Dnipropetrovsk region in 2018 recalculated the client's pension on the basis of the Certificate of the amount of cash for recalculation of pensions as of 01.03.2018, issued by Dnipropetrovsk OTCK and JV in accordance with the Cabinet of Ministers of 21.02.2018 № 103 "Persons discharged from military service and certain other categories of persons" and did not take into account additional types of cash security when calculating the pension.

At the request of the Plaintiff Dnipropetrovsk OTCC and JV prepared a certificate on the amount of cash security of Ivan Vladimirovich from 19.08.2021 №FD 100640 as of 05.03.2019 with information on the amount of monthly additional types of cash security for 01.04.2019 recalculation of the basic pension.

However, the Main Department of the Pension Fund of Ukraine in Dnipropetrovsk Oblast refused to recalculate the pension on the basis of a certificate issued by the Dnipropetrovsk OTCK and SP on the amount of cash security, taking into account additional types of cash security.
Pursuant to the decision of the Dnipropetrovsk District Administrative Court of 14.01.2022 in the case №160 / 23835/21 І.V. and JV for the implementation of the Resolution of the Cabinet of Ministers №103 from 01.04.2019 in the amount of 86% of the cash security of 19596 UAH.

From 01.03.2022 the amount of pension IV, transferred to the execution of the court decision is 19211.92 UAH.

We can conclude that our client's pension has more than doubled.
