RETURN OF MILITARY PENSION 2021: LATEST NEWS

Military pensioner turned to JSB “Prikhodko and Partners” for help in recalculating his military pension. The pensioner was dismissed from military service from the position of inspector of the sector for supervisory and preventive activities of the Manevychi district department of the Ministry of Emergencies of Ukraine in Volyn region.

Until 2018, the Plaintiff was accrued a pension based on the following components of cash security for the calculation of pension:

• salary;
• salary for military rank;
• allowances for years of service;
• additional types of cash security.

In 2018, the Main Department of the Pension Fund of Ukraine in Volyn Oblast recalculated the client's pension on the basis of the Certificate on the amount of cash support for recalculation of pensions as of March 1, 2018, issued by the Main Directorate of the Civil Service of Ukraine for Emergencies in Volyn Oblast. 2018 № 103 "On the recalculation of pensions for persons discharged from military service and certain other categories of persons" and did not take into account additional types of cash security when calculating pensions.

At the request of the Plaintiff, the Main Department of the Civil Service of Ukraine for Emergencies in Volyn Oblast prepared a certificate on the amount of cash security of Vitaliy Vasyliovych dated 07.05.2021 №48-01-1659.2 / 48-12 as of 05.03.2019 with information on the amount of monthly additional types of cash provision for recalculation of the basic amount of pension from April 1, 2019.

However, the Main Department of the Pension Fund of Ukraine in Volyn Oblast refused to recalculate the pension on the basis of a certificate issued by the Main Directorate of the Civil Service of Ukraine for Emergencies in Volyn Oblast on the amount of cash benefits, taking into account additional types of cash benefits.

The decision of the Volyn District Administrative Court of 19.08.2021 in case №140 / 7042/21 obliges the Main Department of the Pension Fund of Ukraine in the Volyn region to transfer to our client from 01.04.2019 recalculation and payment of pension on the basis of a certificate of cash security from 07.05. 2021 №48-01-1659.2 / 48-12, issued by the Main Directorate of the State Service of Ukraine for Emergencies in the Volyn region, with mandatory consideration of the amount of monthly additional types of cash security.

GU PFU in the Volyn region recalculated the pension of our client from October 2021 on the basis of the decision of the Volyn District Administrative Court of 19.08.2021 in case №140 / 7042/21.

The transferred pension of our client from October 2021 is 8733.9 UAH.The amount of debt of the PFU in the Volyn region for the period from 04/01/2019 to 09/30/2021 is 98,436.45 UAH.
