PROHIBITION OF SALE OF BUILDING HOUSING WITHOUT LAND RIGHTS AND LICENSES FOR FINANCIAL SERVICES

On October 2, the Law on Improving the Procedure of Licensing of Business Activities was adopted.

Administrative responsibility for violation of the licensee's term of notification to the licensing authority about the change of information specified in the application and attached documents - a fine from 250 to 500 non-taxable minimum incomes of citizens has been established.

Failure of a licensee to comply with an order to remedy breach of license conditions entails a fine of between 500 and 1500 NMDG.

The Law on Advertising includes a prohibition on the distribution of advertising for the purpose of alienation of the construction object and its parts (including residential and non-residential premises) concerning the construction object, which is constructed using non-state funds, attracted from individuals and legal entities, in including management:

- without the right of the client to construct the property right or use the land on which the advertised object is being built;

- without the right of the customer to construct the right to perform construction works on a particular advertised object, obtained in accordance with the Law "On Regulation of Urban Planning Activity";

- without the presence of the economic entity performing the construction of objects that by the class of consequences (responsibility) belongs to objects with medium (CC2) and significant (CC3) consequences of the license for conducting economic activity on construction of the respective objects ;

- for residential buildings - also without the presence of an economic entity that attracts non-governmental funds of individuals and legal entities, including management, to finance the construction of an apartment building, a license to conduct economic activities in providing financial services (except for professional activities in securities market), namely property management for financing construction and / or real estate transactions in accordance with the Law of Ukraine “On Financial and Credit Mechanisms and Property Management housing or real estate operations ”, or without a certificate of registration of the issue of the target bonds, the obligations under which are secured by the unit under construction.

Requirements for the content of construction advertisements have been established (the details of the permits must be specified).

It also provides for the maintenance of licensing registers, the Register of complaints complaints of licensees, licensees for actions (inactivity) of licensing bodies for violation of licensing legislation.
