PROCEDURE FOR EXITING THE TERRITORY OF UKRAINE IN WARTIME CONDITIONS

Leaving the territory of Ukraine for many did not pose any difficulties before the start of the war. But after February 24, 2022, everything changed. Since the declaration of martial law, citizens have faced such a problem as traveling abroad, namely their restrictions. First of all, men aged 18 to 60 and women who are conscripts faced such restrictions.

Normative legal acts regulating the main points of departure from the territory of our state abroad in war conditions:

• First, the Law "On the procedure for departure from Ukraine and entry into Ukraine of citizens of Ukraine".
• Secondly, the Rules for crossing the state border by citizens of Ukraine, which were approved by the Resolution of the CMU of January 27, 1995  № 57.
• Thirdly, the Explanation of the State Border Service dated 17.03. № 23-6855/0/6-22-Vikh of 2022 "Regarding the procedure for organizing travel abroad during the period of martial law".

The following can freely leave the borders of Ukraine during martial law:

• women who are not conscripted;
• children accompanied by adults;
• men who have reached 60 years of age.

For all others there are certain restrictions. It is possible for conscripted men to go abroad if they are not subject to mobilization.

The categories of citizens who are not subject to mobilization, and therefore can also leave the territory of Ukraine, are provided for in Art. 23 of the Law of Ukraine "On Mobilization and Mobilization Training".

Documents needed to cross the border in wartime?

Border crossing documents for each category are individual. For example, if it is a woman or a man who has three or more children under the age of 18 to support, then there must be birth certificates or other documents confirming that it is the mother or father who supports these children. For persons who provide care for sick family members, a different list of documents, in particular, a court decision on the appointment of a guardian, a certificate from the Ministry of Health and Welfare, or others.

That is, as can be seen from the above, in order to cross the border in the conditions of war, it is necessary to study in detail the life situations of each person individually.
