PROCEDURE FOR COMMISSIONING OF REAL ESTATE OBJECTS WITH CONSEQUENCE CLASS CC3

Buildings and structures of the SS3 class are multi-apartment residential buildings over a hundred meters high, large public buildings, industrial facilities, buildings of universities, colleges, schools, preschools, shopping malls, hospitals, etc. As these are high-risk facilities, their commissioning requires strict compliance with legal requirements, as well as urban planning norms and standards.

Stages of commissioning of CC3 facility

According to Article 26 of the Law №3038-VI “On Regulation of Urban Development” of 17.02.2011, documents for CC3 facilities are accepted only in electronic form. The documents are submitted by the applicant to the State Inspectorate of Architecture and Urban Planning (DIAM), which was established by the Cabinet of Ministers Resolution №1340 “Some issues of the functioning of architectural and construction control and supervision” from 23.12.2020.

To commission a CC3 facility, follow these steps:

  • Get urban planning conditions and restrictions.
  • Develop technical and design documentation.
  • Pass the examination of project documentation.
  • Issue a construction permit.
  • Carry out a technical inventory and obtain a technical certificate of the object.
  • Submit a certificate of readiness for operation and an application for a certificate to DIAM.
  • Issue a postal address.
  • Register property rights.

Submission of documents for obtaining a certificate of acceptance of the object into operation

Documents are submitted online to the state web service. “Action” services. The following important points should be taken into account:

  • the act of readiness of the object for operation is certified by the customer’s CEP, gen. designer, gen. the contractor, some other participants in the construction;
  • a receipt of payment for the certificate must be attached to the documents;

Note: 12,901 hryvnias and 20 kopecks (5.2 living wage for able-bodied people) must be paid for obtaining a certificate for CC3 facility.

  • the application for the certificate is formed automatically on the basis of the data entered into the online form by the applicant, after signing the application is sent to the GASK body at the location of the object;
  • as soon as the certificate is issued, an entry will be made in the Register of Construction Activities.

Importantly! It is not possible to correct the data in the already issued certificate.

According to Article 2 of the Law “208/94-VR” On Liability for Violations in the Sphere of Urban Development “of 14.10.1994, the use of SS3 facilities not put into operation entails a fine of 900 subsistence minimums for able-bodied persons (as of January 2022 – UAH 2,232,900).
