If you have received the land and there is a desire to use it for other purposes, you need to do it legally. Many land users ask themselves where to start and where to go to change the purpose of the land. This will be discussed in more detail below.

 According to the Law on Land Management, lands are divided into nine categories according to their purpose: (agricultural lands, lands of housing and public buildings, lands of water fund, lands of forest, health, historical, cultural and recreational purposes, lands of nature protection fund). Therefore, if the owner or user of the land wants to change the purpose, he needs to follow a certain algorithm.

 First, where to go?

 The current Land Code of Ukraine states that decisions on changing the purpose of land may be made by: the Verkhovna Rada of Ukraine, public authorities and local governments that have authorized the allocation of this land for use or ownership.

 You can change the purpose of the land on the basis of a land management project. That is, you need to apply to any land management organization that has the right to carry out land management work with an application for a project.

 According to the agreement that will be concluded with the land management organization, the land management project must be prepared in electronic and paper forms within the specified period.

 It is then necessary to approve this land management project. To do this, contact the appropriate authorities.

 If this land is located in the village, it is necessary to apply to local governments (village, town or city council) with a request, if the land is outside the village – to the district state administration, and if outside the village or city, which is not part of the district – to the regional state administration.

 Therefore, in order to change the purpose of the land to the owner or land user of this land plot, it is necessary to take the following actions:

  • Apply to the land management organization with a statement on the preparation of the land management project.
  • After receiving the land management project, it is necessary to apply to the EFA or local self-government with a written request for approval of this land management project and change of purpose of this land.
  • Next, you need to apply to the cadastral registrar in the relevant territorial body (district or city department) of the State Geocadastre with a request to amend the information about the land.

 An agreed land management project must be attached to the application. The cadastral registrar has 14 days to review this application and make changes to the information about the land plot or to renew it. The refusal of the cadastral registrar can be appealed in court. The fee for providing the service of making changes to the information about the land plot is not paid.
