Privatization of an apartment (housing) by warrant in Ukraine

Reading time: 3 min.

Are you planning to acquire an apartment or other housing that belongs to the state housing fund? Privatization of an apartment by warrant in Ukraine is one of the activities of PRIKHODKO & PARTNERS lawyers.

Why is housing privatization necessary?

If you wish, you can privatize rooms in dormitories, apartments in multi-apartment buildings, etc. Why is privatization necessary? Only privatized housing can be gifted, sold, mortgaged, bequeathed, leased, etc. In accordance with current Ukrainian legislation, housing privatization is carried out on the basis of a warrant. Only in privatized housing you will be able to carry out redevelopment or reconstruction. Participants in the privatization procedure are: the tenant of the apartment and everyone who was registered in the apartment together with him.

A warrant must be obtained for privatization. A warrant for an apartment is a document that allows you to get ownership of an apartment or other state-owned housing. According to the rules of Resolution No. 470-84-p, a warrant can be obtained only for a vacant apartment or house.

Important: you can privatize an apartment without a warrant. The main thing is that there must be documents confirming the right to use housing (passport registration, registration of various forms, family composition certificate, etc.).

What objects cannot be privatized?

It is impossible to privatize:

  1. Emergency objects, including objects located in the exclusion zone.
  2. Dormitory rooms in reserves, botanical gardens, military towns.
  3. Arbitrarily converted and re-planned residential premises.
  4. Apartments-museums.

What documents are required for the privatization of an apartment (housing)?

The following documents will be required to privatize an apartment:

  • Application for privatization of an apartment.
  • Technical passport of the valid inventory of the apartment.
  • Housing warrant.
  • Copies of documents of all persons registered in the apartment.
  • Documents confirming the right to benefits (if available).

You can get a certificate of ownership within 30 days from the moment of submitting the necessary documents. It will also take some time to collect documents. The lawyers of PRIKHODKO & PARTNERS will help to significantly speed up this process.

Thus, if you live in state housing and did not have time to privatize it, you need to find out whether it is possible to privatize it and what package of documents will be needed for this. As a result, you will become the owner of the Certificate of Ownership. This document allows you not only to live in your own apartment, but also to fully dispose of it (donate, sell, bequeath).

During privatization, such factors as the sanitary area of the dwelling, the number of persons registered in it, etc., are taken into account. In any case, PRIKHODKO & PARTNERS lawyers will be able to free you from bureaucratic red tape.
