Postponement under the new law on mobilization

Reading time: 4 min.

Recently, a new law on mobilization was adopted, which amends the grounds for postponement.

This article outlines the new grounds for deferment under the new law. Let's see which grounds are narrower and which are more detailed.

Under the new rules, the criteria for independent parenting have been clarified, and now they are presented in the form of a clear list of circumstances. However, it is important to remember that if the circumstances specified in the list cease to be valid, the deferral will lose its effect.

It is also a little more restrictive with regard to the disability of the wife. For the first or second groups, there is no need to prove the absence of other persons or a specific disease, but for the third disability group, there are already restrictions related to the disease that led to the disability.

Now let's look at the most common grounds for deferment today, which are student status and caring for a relative, but these grounds have changed.

From now on, if a person is studying full-time, but is receiving a second or third degree, his or her right to deferment will be lost, but at the end of the academic year.

Who then has the right to a student deferment?

Those students who are studying full-time or dual enrollment and obtaining a level of education that is higher than the previously obtained level of education in the sequence determined by the relevant legislation.

Regarding parents with disabilities, now if a family has 2 brothers and they are liable for military service, the mother or father with a disability can choose which of the children will receive a deferment.

What has changed in care?

If a person liable for military service wants to apply for a deferment from mobilization on the grounds of caring for a relative of the second degree of kinship, such a person must have a disability of the 1st or 2nd group, and it will be necessary to prove the absence of other persons of the first degree of kinship.

Does family ties in guardianship matter?

No, the degree of family ties does not matter, and moreover, it is stated that a person recognized by the court as incapacitated does not necessarily have to be disabled.

These rules outlined in this article are the main and most common ones, but they are not all. Therefore, if you have any questions or need legal assistance, do not hesitate to contact a military lawyer for advice. Each case is unique and requires an individual approach and careful analysis.
