In modern realities, when the issue of ensuring national security becomes the highest priority, citizens of Ukraine must take into account their rights and obligations in the context of military duty and mobilization. One of the important aspects is the question of postponement of mobilization for persons who provide care for a disabled person of the 2nd group. In this article, we will consider the legal aspects of this issue and ways to protect the rights of citizens.

Military duty and mobilization are regulated by the Law of Ukraine "On Military Duty and Military Service". According to this law, citizens of Ukraine are obliged to perform military duty, but the law provides for deferments and special conditions for certain categories of citizens.

In order to receive a deferment on the basis of caring for a disabled person, it is necessary to first establish and define the disability group. It is necessary to contact the Medical and Social Expert Commission (MSEK) and establish and document the disability group. It is worth noting that a person with disability group 2 is characterized by an average degree of restriction of life activities.

 

According to the legislation, persons who provide care for disabled people of the 2nd group may have the right to deferment from military service. For this, it is necessary to have appropriate medical documentation and a statement that contains justification and indicates the need to care for a disabled person as a reason for postponement. Among the necessary documents that confirm disability are the MSEK certificate and a disability pension certificate.

If a person with a disability is a spouse, parents of a conscript or parents of a spouse, then in addition to medical documents, documentation confirming family ties with persons with disabilities (marriage certificate, birth certificate, etc.) and documents proving lack of other able-bodied persons who can care for persons with disabilities.

In a situation where a person with a disability is not included in the list of the above-mentioned relatives, in addition to a pension certificate and a certificate from the MSEK, documents must be attached that confirm the absence of other able-bodied persons who can provide care in addition to the conscript.

Citizens seeking a deferment should apply to the Territorial Center for Procurement and Social Support of their district with an application for a deferment and notarized copies of the above documents. There they will be provided with information on the procedure for submitting an application. The application must be clearly formulated, indicate all the circumstances confirming the need to care for a disabled person.
