POSTPONEMENT FROM MOBILIZATION FOR SCIENTIFIC EMPLOYEES

In accordance with the norms of the current legislation of Ukraine, it is possible for scientific workers to receive a deferment from conscription for military service during mobilization.

Thus, the third paragraph of the third part of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization" grants the right to receive a deferment from conscription for military service during mobilization, in particular, to academic staff of institutions of higher and professional pre-higher education, scientific institutions and organizations that have scientific title and/or scientific degree, provided that they work, respectively, in institutions of higher or vocational pre-tertiary education, scientific institutions and organizations, institutions of professional (vocational-technical) or general secondary education at the main place of work at a rate of at least 0.75.

In order to receive a postponement on the above-mentioned basis, it is necessary to have several grounds at the same time:

• to be a researcher of a higher and professional pre-higher education institution, scientific institution and organization;
• have an academic title and/or scientific degree;
• and work in such an institution of higher and professional pre-university education, a scientific institution and organization, an institution of vocational (vocational-technical) or general secondary education at the main place of work at a rate of at least 0.75.

We draw your attention to the fact that it is possible to be a researcher of a scientific institution and organization of any form of ownership, as the law does not provide otherwise. Thus, in accordance with Article 1 of the Law of Ukraine "On Scientific and Scientific-Technical Activity", a scientific (research, scientific-technological, scientific-technical, scientific-practical) institution is a legal entity, regardless of its organizational and legal form and form of ownership, formed in accordance with the procedure established by law, for which scientific and (or) scientific and technical activity is the main one.

However, we emphasize that it is also mandatory to have an academic title and/or scientific degree. On this occasion, there are discussions at the legislative level regarding the exclusion of this condition as mandatory, since scientific workers who do not have them are in a discriminatory position, compared to those who have an academic title and/or a scientific degree.

At the same time, the very existence of these circumstances will not guarantee 100% that you will not be mobilized. It is necessary to apply to the territorial recruitment and social support center where you are registered, with an application to grant you a deferment from conscription for military service during mobilization on the specified basis. Also, all documents confirming the grounds specified in the third paragraph of the third part of Article 23 of the Law of Ukraine "On Mobilization Training and Mobilization" are attached.
