PERMIT FOR IMMIGRATION TO UKRAINE BY TERRITORIAL ORIGIN

This issue is regulated by the Law of Ukraine "On Immigration" and is clarified on the right to issue a permit for permanent residence in Ukraine if there are grounds for acquiring Ukrainian citizenship by origin.

But it should be understood who is already a citizen of Ukraine by birth and residence in Ukraine and who by birth has the right to receive only a residence permit. The distinction for a more detailed understanding is as follows:

• The first aspect that should be paid attention to is the belonging to the citizenship of Ukraine of persons who, until the moment of independence of Ukraine - August 24, 1991, permanently lived on the territory of Ukraine and were born on its territories there. In such a case, a person can count only on receiving a national passport of a citizen of Ukraine, but with the exception of persons who have undergone official procedures for renunciation of Ukrainian citizenship.
• The second aspect is the residence of persons on the territory of Ukraine before August 24, 1999, but leaving its borders after independence for permanent residence abroad.

You can confirm the fact of your birth in Ukraine by presenting a birth certificate or archival certificate of birth. If you want to confirm the fact of residence on the territory of Ukraine before August 24, 1991, then this procedure is established in court.

Of course, difficulties cannot be avoided when applying for a permit to immigrate to our country. These usually include:

• Confirmation of birth in Ukraine is mandatory. If we are talking about people who were born in Ukraine before 1973, almost the majority of them will not be able to obtain a certificate due to the loss of the official record of the birth itself. And if a person is faced with such a problem, then later he will have to go through one of the difficult procedures for restoring the birth certificate, which may last more than three months.
• Entering different personal data in personal documents. Most often, this happens with such documents as a birth certificate and a passport of a person's citizenship. For example, there are countries that do not require the presentation of a birth certificate when obtaining a civil passport for the first time, so the registration and writing of personal data is carried out in the person's own words. Thus, subsequently proving the identity of a person in his documents is impossible.

In such cases, there are only two ways to resolve the above issue:

• The first step is to go to the country of your citizenship and get a new passport.
• The second is to change the birth certificate. If you choose the path of change in Ukraine, then it will be possible only in court. Why not the Civil Registry Office? Because they do not see proper grounds for this and the certificate is the primary document of a person.

Subsequently, after the documents are received by the migration service, within the limits of its legal powers, it sends requests to state authorities to confirm the specified documents and entered data. In addition, the request is sent to the RAGS to confirm the validity of the act record.

The response to the request is received within 5-7 days according to the laws of Ukraine, but according to practice, this period can be extended up to several months. As a result, this will have a direct impact on the terms of consideration of documents for the issuance of an immigration permit.
