Pension to the wife of a deceased military pensioner

Current legislation, namely Law of Ukraine № 2262, defines several types of military pension. It can be based on years of service, in connection with disability and in case of loss of breadwinner. In the event of the death of a military serviceman or a military pensioner, wives have the right to receive a survivor's pension. At the same time, there are different amounts of such a pension, which depend on the circumstances of death.

What exactly depends on the size of the pension?

The circumstances of the serviceman's death affect the size of the pension received by the wife. It can be from 30% to 70% of the financial support provided for in Section 4 of the Law of Ukraine № 2262. In particular, this is referred to in Article 36, which is quite extensive.

For example, if a soldier died or died as a result of illness, contusion or mutilation received during the performance of combat missions in the defense of the Motherland or liquidation of the consequences of the accident at the Chernobyl nuclear power plant, then the disabled wife has the right to 70% of such financial support. If 2 or more disabled family members who were dependent on a military person apply for this financial support, then this refers to the amount of 50 percent of the financial support for each such family member.

If the military serviceman's disability was not related to the performance of combat tasks, but to an accident during military service, the wife will be entitled to a survivor's pension in the amount of 30% of the financial support.

What else is important to know?

Also important is the right of the breadwinner's wife, who is busy caring for his child under the age of 8, to receive an appropriate pension. It is appointed regardless of the wife's age and ability to work. However, it is only about those wives who do not work or do not do military service.

At the same time, if the death of the breadwinner occurred as a result of an injury, contusion or mutilation that he received during the defense of the Motherland or performing other duties of military service, then the wife, who takes care of his child up to 8 years of age, has the right to receive an appropriate pension, regardless whether she works or serves in the military.
