ORDER OF APPOINTMENT OF TARGET PURPOSE OF THE LAND PLOT

The purpose of the land plot is its use for that purpose, which is determined on the basis of the relevant technical documentation on land management and the current legislation.
The land is divided into 9 categories according to the main target destination (Article 19 of the Criminal Code of Ukraine):

a) agricultural land;
b) the land of residential and public buildings;
c) the land of natural reserve and other nature conservation purposes;
d) land of sanitary purpose;
e) recreational land;
e) land of historical and cultural destination;
e) the land of the forest fund;
g) the land of the water fund;
c) land of industry, transport, communication, energy, defense and other purposes.
In accordance with Part 1 of Art. 20 of the Land Code of Ukraine (ЗК), the change of the intended use of land is carried out on the basis of land management projects regarding their allocation (project).
It should be noted that starting from January 1, 2013 (on the day of the entry into force of the Law "On Land Management"), the change of the intended use of land plots of private property does not require any additional permits and prior consent of local authorities and, in accordance with Part 3 of Art. 20 of the Criminal Code of Ukraine, carried out at the initiative of the owners of land plots.
The procedure for changing the intended use of a land plot with a change of category can be divided into several stages:
1) project development;
2) approval of the project by the authorized authorities;
3) approval of the project;
4) amendments to the State Land Cadastre;
5) registration in the state register of rights.
It should be noted that this year in the question of changing the purpose of land plots should also take into account the following.
The moratorium on the alienation of agricultural lands continued until 2018. In this regard, before the entry into force of the law on the circulation of agricultural land, but not earlier than January 1, 2019, the sale or other means of alienation or change in the purpose (use) of land plots shall not be allowed:
- owned by citizens and legal entities, for the conduct of commodity agricultural production,
- allocated in kind (on the ground) to the owners of land shares (shares) for the conduct of a private peasant farm,
- shares (shares), in addition to their inheritance, exchange of land for another land plot in accordance with the law and seizure (redemption) of land for public purposes, as well as in addition to changing the purpose (use) of land plots for the purpose of providing them with investors - participants in production-sharing agreements for activities under such agreements (paragraph 15 of the Transitional Provisions of the Criminal Code of Ukraine).
