Operational reserve in “Reserve+” – lawyer’s explanation

Recently, among those liable for military service in Ukraine, the emergence of a new status in the mobile application "Reserve+" - "operational reserve" - ​​has been actively discussed. This caused a significant resonance, as users began to associate such a mark with possible restrictions, in particular regarding the reservation of employees. What does the status of "reserve soldier" mean?

According to current legislation, a reservist is a person who serves in the military reserve and has the appropriate registration. It is important to understand that the entry in the application itself is not an indisputable confirmation of such status.

Of key importance are:

• the presence of an order to enroll in the reserve;
• entries in military registration documents;
• binding to a specific military unit.

The absence of at least one of these elements calls into question the legality of a person's assignment to the operational reserve. In such a case, the entry "reserve soldier" in the "Reserve+" application does not create legal consequences and cannot be considered a sufficient basis for restricting a person's rights, in particular regarding reservation or receiving a deferment.

Therefore, in the event of discrepancies between the data in the electronic registers and the actual documents, priority should be given to official paper or properly executed electronic documents. In practice, users often encounter a situation where different statuses are displayed simultaneously, for example:

Today, two main reasons for this situation can be identified:

1. Technical error: It is possible that the accounting categories were incorrectly displayed due to software errors. In this case, the problem is temporary and can be corrected without legal consequences.
2. Actual change of status: Another option is to change the data in the state register. This can have legal consequences, in particular:

• refusal to book;
• difficulties with obtaining a deferral;
• additional restrictions on the legal status of the person.

Practical recommendations

If the application displays conflicting information, such as a combination of "reserve soldier" and "requires basic training," this is most likely a technical error. However, the situation should not be ignored.

• submit a written request for confirmation of the accounting category;
• demand the provision of grounds for establishing the appropriate status.

The situation with the status of "operational reserve" in "Reserve+" indicates the imperfection of state registers and the lack of consistency between digital data and the real legal status of the person. In practice, this creates risks - from refusal to book to other restrictions that may be applied without proper grounds.

It is important to understand that it is not the entry in the application that is decisive, but official documents and military registration data. They are the ones that have legal force in case of contradictions.
