OBTAINING A CERTIFICATE FOR GOING ABROAD IN CONNECTION WITH STUDYING AT A FOREIGN INSTITUTION OF HIGHER EDUCATION

In accordance with the Decree of the President of Ukraine dated February 24, 2022 No. 69/2022, the relevant military administration bodies are conducting general mobilization activities in accordance with the Law of Ukraine dated October 21, 1993 No. 3542-ХІ "On Mobilization Training and Mobilization" (hereinafter referred to as the Law).

At the same time, the Law establishes a list of persons who are not subject to conscription for military service during mobilization. Thus, in accordance with Article 23 of the Law, in particular, but not exclusively, students of vocational pre-higher and higher education, trainee assistants, post-graduate students and doctoral students who are studying full-time or dual forms of education are not subject to conscription.

What documents should be paid attention to?

If you are already a student of a higher educational institution abroad, first of all, you need to collect the appropriate package of documents to properly confirm your student status, namely:

•  Agreement with a foreign higher education institution (with annexes).
•  Certificate of acceptance of a foreigner for in-patient education.
•  Invitation to study.
•  Student card.
•  Student's electronic office.
•  Confirmation of payment for training (in the case of a contractual form of training).

The above-mentioned documents must be translated into Ukrainian and the translation certified by a notary in two copies.

What is the category of military duty?

Now we need to decide on your category of military duty. According to Article 9 of the Law of Ukraine "On Military Duty and Military Service", we consider the categories "conscript" or "military conscript", which will later affect the entry in your certificate of registration or military registration document.

Thus, in the event that a conscript is granted a postponement of the draft, in the corresponding section of the certificate of registration to the conscription station, it is necessary to obtain a record of its granting and the granting of permission by the relevant head of the territorial recruitment and social support center to travel abroad in accordance with part 9, 15 of article 17 of the Law of Ukraine "On military duty and military service".

In the event that a conscript is granted a deferment from the draft, a record of its granting and the granting of permission by the relevant head of the territorial recruitment and social support center to travel abroad must be obtained in the relevant military accounting document.

The permission of the relevant head of the territorial recruitment and social support center for travel abroad is a Certificate for travel abroad for students of professional pre-higher and higher education, trainee assistants, post-graduate students and doctoral students studying full-time or dual forms of education.
