Novels for the employment of foreigners in Ukraine.

The last year was reflected in significant changes in the procedure for issuing work permits for foreigners in Ukraine. The main goal of these changes was to declare the desire to European standards and attract foreign investment. Nevertheless, as it turned out, the theory is very different from practice.

Despite a relatively short period of consideration of issues regarding the issuance of work permits, 7 days to receive and 3 days to continue, foreigners are constantly faced with a number of problematic issues.

An example is that the new procedure does not provide for the possibility of obtaining a duplicate of authorization in case of loss. In the case of a "D" visa and an ID card you can try to extend it, but if the permit is lost immediately after issuance and before arrival in Ukraine and filing documents for a certificate, the foreigner will not be able to either obtain a visa or file documents for the issuance of a temporary certificate. In fact, in this case, you must submit a new package of documents.

A clear plus of the changes is a significant reduction in the package of documents required for the issuance of employment permits. It was canceled the filing of a certificate of health, lack of convictions, checking the demand for vacancies.

A significant plus is the change in the procedure for issuing a "D" visa, the multiplexed visa was issued, and the validity period was increased to 90 days. Unlike the previous state, when the mentioned visa was one-time and forced a foreigner to stay in Ukraine until the receipt of the permit. And in case of departure for emergency reasons - it was necessary to re-receive a visa.

Unfortunately, the deadline for obtaining and extending certificates up to 15 working days increased, the legislator did not foresee any mechanisms for expedited / simplified review. Also, at present, a foreigner needs to appear personally in the migration service authorities for filing documents, obtaining a certificate, and also for filing documents for family members. In addition, the minimum wage level for most categories of foreigners is increased to 10 minimum wages.

A separate story is a new provision, which is literally "foreigners and stateless persons (except citizens of the state recognized by the Verkhovna Rada of Ukraine as an aggressor state), who, in accordance with the laws and international treaties of Ukraine, are not obliged to obtain a long-term visa for the issuance of a certificate for temporary residence and received permission to use the work of foreigners and stateless persons not later than 30 days from the date of their last entry to the territory of Ukraine, have the right to apply for obtaining a certificate without leaving the border Ukraine, subject to compliance with the terms defined in paragraph 17 of this Procedure ".

In fact, it is clear from this provision that foreigners from non-visa countries (CIS countries other than Russia) who have received a work permit in Ukraine may not go to submit documents if they have received permission within 30 days from the date of entry.

Positive decisions are that the terms necessary for filing documents for renewal of the permit were canceled, for certain categories of employees (founders, it-specialists, etc.) the validity period of the permit was increased to 3 years. The deadline for reviewing the extension application is reduced to three days.

As a conclusion, it should be noted that the pursuit of the next improvement has led to ambiguous results in which it is difficult to separate unambiguously positive or negative changes.
