NEW RULES OF MILITARY ACCOUNTING. HOW TO PROTECT YOURSELF FROM AN ILLEGAL SUBMASON?

From the New Year, new rules of military accounting came into force. These changes affected both conscripts and enterprises of all forms of ownership. If you analyze the new rules of military accounting, you can understand that a summons can be obtained anywhere. That is, it can be both the place of residence of a conscript, and the place of work or stay in any public place. In fact, there are no restrictions on the delivery of summonses. But not infrequently such subpoenas are served in compliance with the law. And for this, in order not to receive a summons illegally, you need to know and understand your rights and be able to use them in a specific situation.

Rule №1

Carefully read the text of the summons. It must be properly filled out, contain the conscript's data, the time and date on which it is necessary to appear, as well as the signature and seal of the military commissar. If there are inaccuracies in the applicant's personal data or other information (there is no military commissar's signature or seal), then the summons may be considered illegal.

Rule №2

Personal signature. The summons must be delivered under the personal signature of the conscript, whose identity is established before delivery. If the person's data is simply requested without checking the documents, then it is possible that the person may indicate completely wrong information. If the summons was sent through relatives, left in the mailbox or at the door - this is improper notification and delivery of the summons, which creates no legal consequences. The same applies to messages over the phone.

Rule №3

Freedom of movement. Forced delivery to the centers of procurement and social support is prohibited. In other words, the delivery of a summons and immediate delivery to the recruitment and social support center is a gross violation of human rights to freedom of movement. If you are forced to do this, you can call the police or, if possible, contact a lawyer.

 

Rule №4

Refusal to receive a subpoena. If the summons is served in an obviously illegal way or with violations, the conscript has the right to refuse it. An act of refusal must be drawn up in the presence of witnesses. Of course, refusing a subpoena can be considered as evasion of mobilization, but with the help of experts in the field of military law, you can protect your rights.

Rule №5

Do not neglect legal assistance. This is one of the most important rules when receiving a summons. If, after all, you received a summons in person or in another way, it will not be superfluous to get advice from a specialist in the field of law. After all, it is better to go to the recruitment and social support center if you are legally prepared. This reduces the risks of abuse of law by military personnel and increases the possibility of a conscript to observe his constitutional rights.
