New requirements for writing the names of legal entities

The Ministry of Justice of Ukraine registered the order on October 17, 2018. No. 1170/32622, which sets forth in the new edition the requirements for writing the name of a legal entity, its separate subdivision, a public entity, does not have the status of a legal entity, except for organizing a trade union.

These requirements, in particular, stipulate that capital and small letters used in constituent documents and when filling out an application in the field of state registration of legal entities, individuals - entrepreneurs and public formations are considered to be identical.

For writing the names of legal entities are used:

letters of the Ukrainian alphabet - when writing the name of the Ukrainian language;
letters of the Latin alphabet - when writing the name in English;
punctuation and symbols. In particular, now when using the symbol of the number, N is used instead of No., and the ampersand (&) symbol can also be used
Arabic numbers (1, 2, 3, 4, 5, 6, 7, 8, 9, 0) and Roman (I, II, III, IV, V, VI, VII, VIII, IX, X, L, C, D, M).
To write the name of a legal entity, capital letters and small letters of the Ukrainian or English alphabet are used.

The name of the legal entity is taken in quotation marks and indicated directly after the organizational and legal form of the business entity (except for government bodies, local governments, authorities of the Autonomous Republic of Crimea, state and municipal organizations, institutions).

The use of quotes in the name of a legal entity is not a sign for determining the identity of names.

The name of the separate subdivision should contain the words “separate subdivision” (“branch”, “representative office”, etc.) and indicate that it belongs to the legal entity that created the specified separate subdivision.

In general, the procedure for assigning the names of legal entities has not received significant changes.
