"A lawyer is someone who transforms the complexity of the law into the simplicity of justice."
Mobilization of those who did not serve
During martial law, one of the key issues is mobilization into the Armed Forces. The law clearly states that all men between the ages of 18 and 60 are subject to mobilization, except in cases expressly provided for by law. At the same time, completion of military service is not a criterion for exemption from mobilization.
Reserve for mobilization
Persons who have not performed regular military service form the so-called civilian reserve - persons who may be involved in recruiting and replenishing the ranks of the Armed Forces of Ukraine, the National Guard, and other military formations in the event of mobilization.
The only condition for their mobilization is their fitness for military service according to the conclusion of the military qualification commission. At the same time, due to the lack of prior military training, such recruits must first be taught the basics of military affairs in training centers or at training grounds before they can directly join the fighting.
That is why they should not be sent to the front line without proper training. This reserve is an important source for periodic rotational replenishment of personnel in the event of an ongoing armed conflict and the need for additional forces.
Grounds for exemption from mobilization
Exemption from mobilization and exemption from military duty are possible only in cases expressly provided for by the current legislation of Ukraine. The law clearly defines an exhaustive list of benefits and grounds for granting deferment of conscription or armor for certain categories of citizens.
In particular, students, employees of strategic enterprises, parents with many children, guardians of disabled persons, etc. are entitled to a postponement of military service during mobilization.
In other cases, except as expressly provided for by law, refusal to be mobilized is unlawful and entails legal liability under applicable law.
Proper military training
As already mentioned, citizens who have not previously performed military service must undergo mandatory training at training centers of the Armed Forces of Ukraine before being sent to military units. The purpose of such training is to provide recruits with the necessary skills in weaponry, tactical training and the basics of military affairs.
Important! It is strictly forbidden to send mobilized persons to the front line without the proper level of training and skills in handling weapons.
At the same time, in practice, there are frequent cases of violation of these norms due to the human factor and abuse of office. There are situations when conscripts are immediately sent to the combat zone, bypassing the stage of education and training.
Protection of rights during mobilization
Despite the clear requirements of the law, in practice, there are frequent cases of violations of the rights of civilians who are mobilized into the Armed Forces without proper training.
If you have encountered such violations during mobilization or have doubts about the legality of your actions, do not succumb to provocations and emotions, behave in a balanced and correct manner.
