How to protect your right to a deferment?

Particular attention should be paid to situations where a child reaches adulthood (18 years of age) but still requires parental support due to health reasons. In this article, we'll explore who is eligible for a deferment, what documents are required, and how to exercise this right using modern digital tools or by visiting an institutions.

Who is eligible for a deferment?

According to the Law of Ukraine "On mobilization preparation and mobilization," military personnel who have an adult child with a disability have the right to a deferment from conscription during mobilization.

 

What disability group should a child have?

It's important to understand that the law clearly defines categories for deferment on this basis. The right to exemption from conscription is granted to parents of an adult child who has:

  • Disability group I;
  • Disability group II.

Important: If an adult child has a disability group III, this does not give the father (mother) the right to a deferment.

Is it necessary to confirm child support?

This is one of the most frequently asked questions. For the category "parents of an adult child with a disability of group I or II," current legislation does not require separate proof of support. Two facts are sufficient:

  1. Family ties (you are the father/mother).
  2. The child has a recognized disability of the appropriate category.

Unlike deferment for parental care, which often requires proof of the absence of other relatives, the procedure for children with disabilities is more straightforward.

Important: Cabinet of Ministers Resolution № 560 clearly defines the list of documents required for each reason, and the section concerning children with disabilities does not require proof of care or income verification. The TCC has no right to require additional documents from you, such as a court order for maintenance or housing office certificates confirming your shared residence. Your right is based solely on the fact of paternity and the child's health, regardless of whether you live in the same apartment.

List of required documents

In order for the TCC and SP to register your right to a deferment, you must provide a clear set of documents.

  • Documents to confirm a child’s disability:

- You will need one of the following documents:

- A certificate for the MSEC examination report in the form determined by the Ministry of Health.

- Extract from the expert team's decision on the assessment of the person's daily functioning.

- A certificate that confirms the relevant status (person with disabilities).

- A pension certificate or a certificate of assignment of social assistance (in accordance with the Laws “On state social assistance to persons with disabilities from childhood and children with disabilities” or “On state social assistance to persons not entitled to a pension...”), indicating the group and reason for disability.

- A certificate for receiving benefits (for persons not entitled to a pension or allowance), according to the form of the Ministry of Social Policy.

  • Documents to confirm family relationship:

- A child's birth certificate, where the conscript is listed as the father.

How to exercise the right to a deferment in 2026?

Today, the state offers several ways to submit an application, from digital services to traditional visits.

Via the Reserve+ app

The fastest way is to use the online deferment feature in the Reserve+ app. If your child's information and disability details are included in government registries, the deferment can be applied automatically.

  • Pros: No queues, fast.
  • Cons: Registries are often out of sync, and the app returns an error or "data not found."

Applying for a deferment through the Administrative Service Center

You can contact your nearest Administrative Services Center. An administrator will help you create a request and upload the required scanned copies of documents into the system.

When should you contact a lawyer?

In practice, conscripts often encounter certain obstacles: The Administrative Service Center requires additional documents that are not required by law, or does not scan all the required documents. They inform the person in advance that there is no point in submitting documents because they are allegedly not eligible for a deferment. Conversely, they confuse the grounds on which the person should submit their application.
