Every citizen has the right to receive a decent pension. Military personnel are the category of citizens who must have a decent financial security upon retirement. But unfortunately, in practice, everything turns out differently. Quite often, in order to receive a decent pension, a serviceman needs to spend a lot of effort and time and go to court for help.

Legislative basis:

This issue is regulated by the Law of Ukraine "On pension provision of persons released from military service and certain other persons".

Types of pensions that military personnel can apply for:

  • for years of service. This type of pension is possible upon reaching a certain age and period of military service.
  • in connection with the onset of disability. If a person received a disability related to military service, he has the right to receive this type of pension on the basis of the above-mentioned Law.
  • in case of loss of breadwinner. This type of pension can be applied for by dependents of a deceased serviceman.

What is the pension provision of military personnel?

  • Allowances Depending on the type of pension a military pensioner receives, the amount of the allowance may vary. This is regulated in accordance with the Law "On the status of war veterans, guarantees of their social protection"
  • Surcharge in accordance with Resolution of the CMU № 713

How is the pension calculated?

Pensions are calculated as a percentage of the amount of cash support. This includes salaries paid by position, military (special) rank, seniority, other payments paid in the amounts specified by law. That is, from all payments from which the EUV was paid.

It should be noted that starting in July 2021, military pensioners and pensioners of other law enforcement agencies, who resigned before March 1, 2018, will receive 2,000 hryvnias for each place. Those who retired after March 1, 2018, this supplement is not paid.

 

But there are also certain nuances with this, for example, after the pensioner receives a court decision to recalculate the pension, that is, the allowances are returned or the pension is increased in another way, the specified 2,000 hryvnias cease to be paid.

But this practice is not entirely legal, and the decision to refuse to pay an additional payment in the amount of UAH 2,000. can also be challenged in court.

So, as can be seen from the above, the pension of a military serviceman consists of various components. Unfortunately, when assigning a pension, PFU specialists do not always inform the pensioner about all payments to which he is legally entitled.
