MILITARY PENSIONERS DENY PENSIONS. LEGAL SUPPORT

Until 2018, the Claimant was awarded a pension based on the following components of financial support for pension calculation:

• official salary;
• salary for a military rank;
• seniority allowance;
• additional types of financial support.

In 2018, the main administration of the Pension Fund of Ukraine in the Dnipropetrovsk region recalculated the client's pension on the basis of the Certificate on the amount of monetary support for the recalculation of pensions as of March 1, 2018, in accordance with the Resolution of the CMU of 21.02.2018 № 103 "On the recalculation of pensions for persons dismissed from military service, and some other categories of persons" and did not take into account additional types of financial support when calculating the pension.

At the request of the pensioner, the Dnipropetrovsk OTCC and JV prepared a certificate on the amount of financial support as of 03/05/2019 for a similar position (on the day of dismissal) held by Volodymyr Leonidovych, indicating monthly additional types of financial support.

However, the Main Directorate of the Pension Fund of Ukraine in the Dnipropetrovsk region refused to recalculate the pension based on the certificate issued by the Dnipropetrovsk OTCC and JV on the amount of financial support, taking into account additional types of financial support.

Pursuant to the decision of the Dnipropetrovsk District Administrative Court dated June 24, 2022 in case № 160/4415/22, Volodymyr Leonidovych's pension was recalculated from April 1, 2019 in the amount of 50% of the financial support of UAH 18,877.33, which is specified in the certificate dated September 15, 2021 № FD81392, which was provided by the Dnipropetrovsk OTCC and the Joint Venture of the Ministry of Defense of Ukraine.

Supplemental pension payment for the execution of the court decision for the period from 04/01/2019 to 08/31/2022 amounts to UAH 168,285.19. As of March 1, 2022, the amount of our client's pension is UAH 10,760.03.

This debt is recorded in the Pension Fund of Ukraine. In accordance with Article 8 of the Law of Ukraine "On pension provision for persons discharged from military service and certain other persons", the payment of pensions, including additional pensions, supplements, allowances and increases to them, compensatory payments, established by law, to servicemen discharged from service, persons entitled to a pension under this Law and their family members are provided at the expense of the State Budget of Ukraine.
