Migration changes for foreigners in Ukraine

Summer in Ukraine began with a series of legislative changes in the regulatory migration sector. The previously announced changes to the registration of residence permits in Ukraine were implemented in the form of the introduction of two Decrees of the Cabinet of Ministers of Ukraine.

No. 321 "On approval of the specimen, technical description of the form and the Procedure for the issue, issue, exchange, cancellation, transfer, withdrawal, return to the State, recognition invalid and destruction of the residence permit ", as well as No. 322" On approval of the specimen, the technical description of the form and the Procedure for the issue, issue, exchange, cancellation, transfer, withdrawal, return to the State, invalidation and the destruction of a temporary residence permit ".

The main achievement of these resolutions is the declaration of the necessity of obtaining documents in a new format in the form of cards with contactless electronic information media for all without exception of foreigners and stateless persons who have arrived in Ukraine for permanent or temporary residence. That is, in fact, all residence permits in Ukraine will be gradually transferred to the format of so-called ID-cards.

On contactless carriers there will be information on the front and back, which will include biometric data, human parameters (digitized person's image and signature), as well as additional variable information and information to provide information security.

In addition to the introduction of a fundamentally different and modern format of documents for foreign citizens, the main changes in the issuance of certificates can be divided into the following blocks:

Temporary residence permit

It is necessary to consider that the existence of a temporary residence permit in the form of a blue book of paper with the marks on the continuation went back to the past. According to the new regulations, the extension of the temporary residence permit is now impossible.

The validity of the new model certificate will be 1 calendar year and no later than 15 days its owner will be obliged to apply to the Migration Service for the registration of a new one.

Therefore, we advise foreigners and stateless persons whose validity expires to apply immediately to the law firm "Prikhodko & Partners" or to the migration service themselves for processing new format documents.

Permanent residence permit

Considerable changes were also made to permanent residence cards, which, before the entry into force of the above regulations, were issued indefinitely, requiring only a photo change of 25 and 45 years.

From now on, the permanent residence permit is reduced to 10 years. The certificate of the old model is subject to exchange also in connection with the achievement of the owner of the age of 25 or 45 years.

Submission of documents for initial receipt or replacement is required within 15 calendar days. Replacing the certificate of a new sample will be possible in case of loss, change of information in it, found errors or inapplicability for use. And also in case of reaching 25 or 45 years if the document is an old sample.

The grounds for canceling the residence permit are now the fact of the abolition of the immigration permit, which is now being formalized in the first place, as well as the disclosure of the facts of the submission of non-truthful information. In this case, the cardholder must withdraw from the registration and leave Ukraine.

Nevertheless, to ensure the provision of all territorial bodies of the State Migration Service the necessary technical resources for the production and registration of certificates of a new format, certificates for permanent and temporary residence will be issued in the form of paper booklets.

It should also be noted that the certificates of the old model are designed and manufactured on the basis of documents submitted before the introduction of new regulations or the provision of production of certificates of a new sample, are valid and valid for the entire term for which they were issued.
