Maximum pension for military personnel in 2024

In 2024, changes were made to the maximum pension amount for military personnel. Thus, it increased from UAH 20930 to UAH 23610. It is easy to predict that these changes will result in more and more litigation with the Pension Fund of Ukraine. What is the maximum pension without any limit on the amount?

In this context, the legislative provision on indexation of pensions exceeding 10 subsistence minimums is important. In accordance with paragraph 2 of Resolution No. 185, pensions are indexed within the maximum pension amount determined by law.

To explain it in simpler terms, just as with the indexation of military pensions in 2022 and 2023, pension indexation will be accrued from March 1, 2024, but will not be paid to the following categories of military pensioners

• those who are paid at the level of no more than ten subsistence minimums for persons who have lost their ability to work. This means that the pension will be subject to a maximum amount limit, which will be UAH 23,610.00 starting in March 2024;
• persons who have defended their right to receive a pension without a maximum amount limit in court and receive a pension in the full amount of its accrual.

This means that the aforementioned category of military retirees will have to defend their right to receive pension indexation from March 1, 2024, in court again.

What are the conclusions from this situation?

First, it is worth noting that nothing fundamentally new has happened. An identical situation regarding the limitation of the maximum pension amount occurred in 2022 and 2023. Therefore, for lawyers who handle such cases, they are already familiar. This means that in such cases, the algorithm for protecting clients' interests is well established.

Secondly, we need to remember the practice of the Constitutional Court, which we regularly mention in our materials and which shows that it is illegal to restrict the constitutional right of citizens to the pension benefits they are entitled to. Therefore, such cases are winnable - and this is the key conclusion that the client should keep in mind.
