List of documents for participation in the Prozorro tender

Since its introduction in Ukraine, public procurement has started to play a significant role in the country's economy, as its main principles are to ensure transparency, fair competition and effective use of public funds. Is there a standard list of documents for participation in the Prozorro tender?

Unfortunately, today Ukrainian legislation does not provide a standard list of documents for participation in the tender, since each public procurement requires various types of documentation necessary to become a participant in it. So, for example, tenders for the purchase of natural gas, electricity, or medicines require the supplier of the corresponding product to have business licenses, and in the situation where the subject of the purchase is repair work, the submission of an estimate for such work, etc., becomes a mandatory part of the documentation.

Without which documents is it impossible to participate in the Prozorro tender?

The standard list of documents for participation in the Prozorro tender consists of:

• Documentation that confirms your identity. For example, for natural persons, it is a passport of a citizen of Ukraine or another identity document, and for legal entities, it is a charter, an extract from the EDRPOU or another founding document of the organization (both the original and a copy of these documents can be submitted);
• Documentation confirming the availability of qualification criteria. In general, they confirm the fact that a potential participant in public procurement has certain skills, qualifications to perform the work set by the tender customer, provide certain services or deliver goods. Such documents can be various certificates and work experience, the presence of a staff list from a legal entity, certificates about the material and technical base, etc.

• Tender offer. It may contain conditions, proposals regarding the price of the subject of purchase, its technical characteristics, the period during which it is planned to perform the work, deliver the corresponding product or provide certain services, etc.
• Documentation that confirms the current status of the taxpayer. If you are a VAT payer, you can provide a VAT payer's certificate or certificate, and for single tax payers - a single tax payer's certificate or certificate. You can also submit relevant extracts from the register of VAT payers and the single tax.
• Proving the absence of justified reasons for rejecting the tender offer. This is necessary so that the customer is sure that your tender offer does not contradict the norms of Ukrainian legislation and that you really have the right to submit a tender offer. Such reasons can be: the commission of corruption offenses or other economic crimes (for example, anti-competitive measures), the initiation of a bankruptcy case or the start of a liquidation procedure, indebtedness to the state for the payment of taxes, etc.
