List of documents for MSEK for military personnel
Passing the medical and social expert commission is a rather complicated procedure in the current conditions. The many publicized stories of service members suggest that this interaction often becomes stressful. It still carries the remnants of bureaucracy and the devaluation of human problems. That is why, in order to minimize the impact of these phenomena for yourself, you should seek legal support of the case from those who understand helping military personnel in the legal field. Lawyers from military law are part of the team of the Prikhodko&Partners law office.
What is the procedure for referral to MSEK?
If a military man is not currently dismissed from the ranks of the Armed Forces, then he can be referred to the MSEK by such subjects as:
- HF medical company;
- military or civilian medical institutions;
- hospitals;
- hospitals where he was treated or rehabilitated after an illness, injury or contusion.
At the same time, there are cases when a military man did not pass the MSEK before his release. Then he needs to take a referral from the Military Commissariat. Let's consider what documents are required to pass this commission.
List of documents
So, you will need:
- passport or ID card + proof of place of registration;
- military card or temporary identity card of a conscript (or conscript);
- referral to MSEK according to the form prescribed by law (file no. 088/o);
- medical documentation in the MMC form of extracts from the outpatient card, medical history, examinations;
- outpatient card of the patient;
- a certificate from the MMC and a certificate of illness from the institutions where the soldier was treated;
- a certificate of fitness for military service (this document is not mandatory, it is attached if necessary);
- a certificate that records the circumstances when the injury occurred (illness or contusion);
- UBD certificate;
- documents certifying the direct participation of the military in the defense of the state.
When it comes to the passport and ID card, the serviceman submits copies. As for medical documents, originals are required.
What conclusions can be established by the MSEK
Such conclusions may refer to:
- disability group, which reflects the state of health of a serviceman;
- the percentage by which working capacity is lost;
- presence of a need for prosthetics;
- an individual program, which is necessary for proper rehabilitation;
- individual testimony regarding the right to receive special road transport.
As practice shows, the military does not always agree with the conclusion recorded by the representatives of the MSEK. There are common cases when the state of health of a wounded, injured or sick soldier is much better in the documents than in reality. In such a case, there is a need to challenge an unfair conclusion. Here, our legal assistance can also be appropriate and necessary.
Despite the fact that today some deputies and public figures have taken up the task of reforming the MSEK phenomenon, such reforming will be a fairly systematic and long-term process until its first really tangible results can be seen.
And for now, in order to ensure fair treatment and impartiality, it will be appropriate to get high-quality legal support for the procedure.
