The war has been going on for more than a month and it is not clear when it will end. But the circumstances of servicemen change, the circumstances change, including family circumstances, which give the right to release from military service.

According to Art. 26 of the Law of Ukraine "On Military Duty and Military Service", one of the grounds for exemption from military service is family circumstances.

List of family circumstances that give the right to exemption from military service

  • Having three minor children to support. This circumstance does not require that it should be blood. For example, if there are dependent children from the wife's previous marriage, then in this case this is also a reason for dismissal from military service, but if there are documents confirming that it is the serviceman who supports them, one of such documents can be a court decision establishing the fact of stay dependent
  • Spouse/husband's disability or parents' disability of group 1 or 2. The documents confirming this fact are the MSEK certificate and a document confirming family relations.
  • Raising a child with a disability under the age of 18, or an adult child with a 1st or 2nd group of disabilities
  • Independent upbringing of a minor child
  • The need to provide care on a non-professional basis for persons who need it.

Documents giving the right to dismissal

Depending on the family circumstances that give the right to exemption from military service, the list of documents may differ slightly, because each circumstance is individual. For example, if the dismissal is based on the presence of a group 1 or 2 disability in one of the parents, it is necessary to provide a copy of the MSEK certificate on the assignment of the disability group, a copy of the identity document (passport) and a copy of the document confirming the family ties between the father or a mother and a military serviceman (birth certificate).
It is important that such documents must be properly certified, i.e. notarized.

 

How to exercise your right to exemption from military service due to family circumstances?

  • Submit a report to the unit commander stating the reasons for dismissal
  • Add duly certified documents confirming the family circumstance that gives the right to exemption
  • Receive an order for dismissal from military service
