Liability and fines for violations of labor legislation

The labor legislation of Ukraine is designed to protect the rights and interests of employees, guaranteeing them decent working conditions and fair remuneration. On the other hand, it also establishes certain obligations for employers, the violation of which entails liability.

Types of liability for violations of labor legislation

  1. Disciplinary liability: applied to employees for violating labor discipline. It can be a reprimand or dismissal.
  2. Material liability: provides for the compensation of damages caused by the employee to the employer.
  3. Administrative liability: imposed on officials and private entrepreneurs for their violation of labor legislation. Fines for administrative offenses in the field of labor reach significant amounts.
  4. Criminal liability: applies in cases of serious violations of labor legislation that caused serious consequences.

The most common violations of labor legislation

  • Non-registration of labor relations with employees ("shadow" salary).
  • Non-observance of work and rest regime.
  • Untimely and incomplete payment of wages.
  • Illegal dismissal of employees.

Penalties for violations of labor legislation

From April 1, 2024, fines for violations of labor legislation have increased. Here is a short list of the main fines and reasons:

  1. Non-registration of labor relations:
  • Fine: UAH 80,000 for each employee.
  • The reason: ensuring the protection of workers' rights and preventing "shadow" employment.
  1. Salary payment in "envelopes":
  • Fine: UAH 80,000 for each violation.
  • The reason: ensuring payment of proper wages and payment of taxes.
  1. Violation of payment guarantees:
  • Fine: from UAH 24,000 for each violation.
  • Reason: ensuring compliance with minimum wage, overtime pay, vacation and other benefits.
  1. Other violations:
  • Fines from UAH 8,000 to UAH 128,000.
  • Reasons: ensuring compliance with labor legislation, protection of workers' rights and prevention of unfair competition.

Important: fines are calculated on the basis of the minimum wage, which from April 1, 2024 is UAH 8,000. Fines may be doubled for repeated violations within a year.
