Length of service in the Armed Forces of Ukraine
Table of Contents:
For military personnel, length of service is a significant factor that affects the amount of cash benefits (hereinafter referred to as «CB»). In the future, the amount of pay and the size of the pension will largely depend on this factor. The higher the length of service, the higher the pension a serviceman will receive.
If you want to find out what kind of pension you can expect, or whether the amount of pension you are entitled to is correct, the lawyers of Prikhodko & Partners Law Firm offer their advisory services on this issue. Our law firm specializes in handling clients' requests that are at the intersection of military and pension law. In the meantime, we suggest that you familiarize yourself in more detail with how the current legislation regulates the calculation of pensions based on length of service.
How is seniority calculated?
So, the calculation principles are as follows:
- If a serviceman has 25 years of service, his pension is calculated at 50% of his CB for the last 24 months of service + 3% for each additional year of service.
- If a serviceman has reached the age of 45 and has completed 25 years of service, of which at least 12 years and 6 months are military service, his pension will be 50% of his CB for the last 24 months + 1% for each additional year of service.
- If a serviceman is discharged for health reasons and has 25 years of service, his pension will be 55% of the CB + 3% for each year of additional service.
As for the maximum service pension for a discharged serviceman, it can be up to 70% of the CB that he had during the last 24 months of service. The maximum pension amount for those servicemen who are «Chernobyl victims» is somewhat different. If a serviceman was a liquidator of the Chornobyl accident at the time of service, his maximum pension can be 95% or 100% of his pay. For category 2, the maximum figure is 95%, and for category 1 - 100%.
What are the conditions for granting a long-service pension?
A serviceman can apply for a long-service pension, regardless of age, if he or she has 25 years or more of calendar service. In the case of the so-called mixed service, the serviceman must be at least 45 years old and have at least 25 years of service, of which 12 years and 6 months must be in the security forces.
What can we do for you?
Military retirees often face violations of their rights in practice. For example, this concerns the incorrect calculation of length of service (especially when it comes to preferential service) or the incorrect calculation of the amount of financial support that affects the amount of the pension. In such cases, professional legal support often helps to move the case forward and achieve justice. We provide such services as:
- Consultations. This can be either face-to-face counseling in our office or online.
- Legal support. We will take all the necessary actions where your presence is not required. This will save you a lot of time and effort.
- Representation in court. If the Pension Fund refuses to grant the proper amount of pension provided for by law, it is often a lawsuit in administrative proceedings that becomes an effective tool to move the case forward.
