LEGALIZATION OF THE EXTENSION TO THE DWELLING BUILDING. ALGORITHM

Most owners of private houses are sure that they have the right to build any extensions on their own land. However, according to modern Ukrainian legislation, unauthorized construction involves the collection of fines. In order to legitimize an extension to a residential building, it is mandatory to obtain appropriate permits.

What is considered an extension? An extension is any object that is directly connected to a residential (main) building.

The extension belongs to the category of major changes in the planning of the house. The legalization procedure directly depends on the time when this structure was built:

  • Until 1992 – a simplified scheme.

It is not necessary to put the extension into operation. The thing is that until August 1992 there were no requirements in the Ukrainian legislation regarding the commissioning of buildings. Thus, the legalization of the construction of an extension does not provide for fines for unauthorized construction. In order to register the right of ownership, it is enough for you to go through the technical inventory process. We are talking about a technical passport with data on the year of construction of an extension to a residential building. The extension is registered precisely on the basis of this document.

  • After 1992, legalization involves a more complicated process.

The first stage is the preparation of relevant documents:

  1. Passport and TIN of the owner (co-owners).
  2. Documents for the right of ownership (for the house and the land plot on which the annex is located).
  3. Technical passport.
  4. A sketch of the future construction or project.

The second stage of legalization of the extension provides for:

  • Development of technical documentation, where all objects of the extension will be indicated.
  • Technical report from the engineer. Required in cases where we are talking about additional buildings with an area of more than 100 m² and up to 300 m².
  • Registration of a declaration confirming the readiness of the building for further use.
  • Issuance of a certificate on the assignment of the building to its own postal address.
  • Entry of the extension into the register of real estate.

After passing this stage, the owner receives an extract of the ownership right to the real estate.

For objects whose area is from 300 to 500 m², there will be another stage - it is performed only after obtaining a technical passport. It is necessary to conclude a confirmation agreement regarding participation in urban/rural infrastructure.

An extension to an apartment building is issued only by the fact of construction. For this, it is necessary to obtain the consent of the neighbors. The next stage is the preparation of documents for the land, obtaining town planning conditions and restrictions. Then everything follows the standard scheme: preparation of the project → technical passport → registration of the declaration.
