LAWYERS OF AB “PRIKHODKO&PARTNERS” CARRIED OUT A SUCCESSFUL MILITARY PENSION CALCULATION

Evgeny Arkhipovych turned to JSC "Prikhodko&Partners" for help in recalculating the military pension. The pensioner was dismissed from service by the order of the Head of the State Special Forces № 579-os dated 25.12.2008 from the position of head of the territorial unit, with the special rank of colonel of the State Special Forces and is registered with the Main Department of the Pension Fund of Ukraine in Kyiv.

In 2018, the Main Directorate of the Pension Fund of Ukraine in Kyiv recalculated the Claimant's pension on the basis of the Certificate on the amount of monetary support for the recalculation of pensions as of 03/01/2018, issued by the Administration of the State Service of Special Communication and Information Protection of Ukraine E.A. in accordance with Resolution of the CMU dated February 21, 2018 № 103 "On recalculation of pensions for persons discharged from military service and certain other categories of persons" and did not take into account additional types of financial support when calculating the pension.

At the pensioner's request, the State Special Communications Administration provided the PFU State Administration in Kyiv with certificate № 40 dated 14.09.2020 about the amount of financial support for the transfer of pension as of 05.03.2019 for the relevant position, taking into account additional types of financial support, which is confirmed by the Administration's response to the civil service of Special Communications and Information Protection of Ukraine dated September 14, 2020 № 14/02-3220.

However, the Main Directorate of the Pension Fund of Ukraine in Kyiv refused to recalculate the pension based on the issued certificate on the amount of financial support, taking into account additional types of financial support.

In February 2022, in order to implement the decision of the District Administrative Court of Kyiv dated 07.09.2021 in case № 640/525/21, in February 2022, from 01.01.2018, the pension of Yevhen Arkhipovych was recalculated in accordance with the procedure established by the court decision, and funds were charged for the period from 01.01.2018 to 02.28.2022 in the amount of UAH 217,966.

From March 2022, the amount of E.A. pension, calculated to comply with the court's decision, amounts to UAH 18,156.81.
