The main features of Article 194 of the Criminal Code

To begin with, we will consider the objective and subjective side of the offense under Article 194 of the Criminal Code.

The objective side

The objective side is damage/destruction of someone else's property. This leads to the task of great material damage.

Destruction of property means loss of its value and lack of possibility of recovery. At the same time, the damaged property loses part of its functionality or value. Property damage that exceeds 250 times the NMDH is considered large.

The subjective side

The subject of the crime under Article 194 of the Criminal Code must necessarily have the appropriate intent. That is, he must act deliberately with the intention of causing damage to the property interests of third parties. By the way, motives can be not only the desire for enrichment, that is, material benefit.

Article 194 of the Criminal Code also defines special circumstances that affect the degree of punishment. This is, for example, damage/destruction of property by arson, use of explosives, etc. Such actions can provoke the death of people or other serious consequences.
