Lawyer under Article 128 of the Criminal Code – Careless serious or moderate bodily injury

Reading time: 4 min.

Causing bodily harm as a criminal offense is incriminated quite often, but there are often cases when the suspect assures that he did not intend to cause such serious harm to the victim. Negligent personal injury lawsuits are quite complex and require attention to every detail, as it is necessary to establish the correct qualifications. If you are a victim or you are charged under Article 128 of the Criminal Code, contact the lawyers of the company "Prіkhodko and Partners", who will help you at any stage of the criminal case.

Features of qualification

Ukrainian criminal law stipulates that a person is liable for committing only serious or moderately serious bodily injuries due to negligence. However, if the injuries inflicted on the victim are only minor and were caused casually, then this does not constitute a crime under the law and, therefore, such a person cannot be brought as a suspect.

Importantly! A person cannot be held responsible for bodily injuries specified in Article 128 of the Criminal Code, if he could not foresee them or was not at fault. This means that there is no intention. It is also worth noting that only a person who has reached the age of 16 can be held responsible for this crime. If such injuries lead to the death of the victim, it is already qualified as causing death by negligence under Article 119 of the Criminal Code.

What criminal liability is provided for negligent serious or moderate bodily injury?

A person may receive one of the following punishments:

  • Imprisonment for up to two years;
  • Up to two years - restriction of freedom;
  • Up to two years - corrective works;
  • From 150 to 240 hours - public works.

What to do if you are injured due to carelessness?

  1. If you are injured as a result of the actions of another person, it is important to immediately contact the police or call 102.
  2. Submit a written statement describing the event in detail, indicating the location of injuries and possible witnesses.
  3. It is also necessary to contact medical institutions to record injuries in medical documents. If possible, the victim may consult with a medical examiner to assess the injuries and their severity.

What to do if you carelessly caused serious or moderate bodily injury?

In the event that you are accused of committing a crime under Article 128 of the Criminal Code, you need to decide which line of defense to choose. One option may be to plead guilty in order to avoid claims from the victim and close the case. Another may be a complete refusal to admit guilt. Choosing the right strategy during a trial can be critically important, so experienced lawyers from Prіkhodko & Partners can help you choose the best line of defense.
