Classification of the concept of "bodily injuries"

The modern criminal legislation of Ukraine defines the following classification of bodily injuries: light, medium and severe (Articles 125, 122 and 121 of the Criminal Code, respectively). As for serious bodily injuries, additional signs for qualification are provided for them.

The degree of severity is determined by a forensic expert in accordance with the existing Rules for determining the severity of bodily injuries.

What is the measure of responsibility provided for by Article 125 of the Criminal Code?

Liability for intentional infliction of minor injuries varies depending on the severity of the committed actions. These can be, for example, fines (up to 100 NMDH), community service (up to 240 hours), correctional work (up to one year), restriction of freedom (up to 2 years), arrest (up to 6 months).

Article 125 of the Criminal Code clearly defines what constitutes minor injuries. This is a short-term health disorder that does not involve long-term disability. As for practice, such injuries include bruises, concussions, etc.

Causing light bodily harm is considered a misdemeanor by criminal law. This means that the investigator, whose activities are coordinated by the prosecutor, is responsible for conducting the pre-trial investigation. The main features of the pre-trial investigation:

  1. Promptness (72 hours after the suspicion was served, the prosecutor is obliged to send the indictment).
  2. In the documents (application, description of investigative actions, etc.) it must be written how the infliction of certain physical injuries occurred).

Please note: minor injuries caused unintentionally (for example, due to carelessness) are not punishable under current legislation. Those light bodily injuries that were caused intentionally are criminally punishable. The concept of bodily harm is not the same as the concept of beating. Beatings involve repeated application, while the traces of such an impact are almost imperceptible.
