As you know, each land plot has its own purpose. If everything is more or less clear with land for construction and horticulture, then land plots with the purpose of "industrial land" suggest that such land can be a factory or an enterprise. And there is a grain of truth in this.

After all, according to the Land Code of Ukraine, land plots on which industrial objects are located or are used to ensure the operation of such objects are recognized as industrial lands. For example, land plots on which communications, engineering networks, etc. are laid.

Who is the owner of such lands?

This category of land can be owned by the state, society (communal property) or individual individuals (individuals or legal entities). That is, ownership of this category of land is no different from others.

Who can get ownership of industrial land in Ukraine?

For industrial land, one of the features is that the land plot with such purpose is inextricably linked with the object located on it. And in the case of alienation of the object, the land plot is also alienated, and vice versa, the owner of the land plot cannot alienate it without the object located on it.

Lease

Another interesting point is whether such a category of land can be leased. Of course, maybe, but again with certain features. The lease of industrial lands may occur when the subject will use it for its intended purpose, that is, for industry.

The lease of land plots from industrial lands is divided into:

  • for the construction and subsequent operation of an industrial facility;
  • for the operation of an already built object.

 

Purpose of land and its change

In theory, it is possible to change the purpose of such a category of land, but in practice it is difficult to do so. This is due to the fact that usually the land of the industry is inextricably linked with certain industrial facilities. And what is important is that the lands of the industry are not agricultural lands, therefore it is impossible to practically change their purpose.

It is worth noting that in accordance with the Land Code of Ukraine, a land easement can be established on industrial lands (Article 66 of the Land Code of Ukraine).
