INCREASE OF THE MILITARY PENSION IN 2022

Mykhailo Vasyliovych turned to Law Office "Prikhodko&Partners" for help in recalculating the military pension. The pensioner was released from military service from the structures of the Ministry of Defense of Ukraine.

Until 2018, the Claimant was awarded a pension based on the following components of financial security for pension calculation:

• official salary;
• salary for a military rank;
• seniority allowances;
• additional types of financial support.

In 2018, the main administration of the Pension Fund of Ukraine in the Lviv region recalculated the client's pension on the basis of the Certificate on the amount of monetary support for the recalculation of pensions as of 01.03.2018, in accordance with the Resolution of the CMU dated 21.02.2018 № 103 "On the recalculation of pensions to persons who are dismissed from military service, and some other categories of persons" and did not take into account additional types of financial support when calculating the pension.

The Lviv Regional Territorial Center for Staffing and Social Support prepared a certificate on the amount of financial support as of 03/05/2019 from 10/27/2021 № 10638 for a similar position (on the day of dismissal) held by our client, indicating all monthly additional types of financial support. The original certificate dated 10/27/2021 № 10638 was sent to the Pension Fund.

However, the Main Directorate of the Pension Fund of Ukraine in the Lviv region refused to recalculate the pension on the basis of the certificate issued by the Lviv OTCC and JV on the amount of financial support, taking into account additional types of financial support.

On 06.04.2022, the Lviv District Administrative Court in case № 380/3084/22 based on the above-mentioned claim made a decision to satisfy the claim of Mykhailo Vasylyovych, by which it decided:

to oblige the Main Department of the Pension Fund of Ukraine in the Lviv region to recalculate and pay the pension to Mykhailo Vasylyovych based on the certificate of the Lviv Regional Territorial Center for Staffing and Social Support dated 10/27/2021 № 10638, taking into account previously paid amounts.

From 01.08.2022, the State Administration of PFU in the Lviv region recalculated the pension of Mykhailo Vasyliovych based on the decision of the Lviv District Administrative Court № 380/3084/22.

The listed amount of M.V. pension as of August 1, 2022 is UAH 20,270.

The amount of debt of the PFU State Administration in the Kyiv region for the period from 04/01/2019 to 08/01/2022 is UAH 229,928.08.
